Show THE COURT AT PROVO 8 The Famous Smit Huge tuble Case is Now On Cae DEFENDANT DENIES HIS GUILT Tile Story of the Girl Very Plainly Told The Evidence all in and the Case Submitted The First district court met at Provo at 10 oclock yesterday The caso of the United States vs John C Harper was taken up for trial Fannie Coombs the alleged plural wife testified I was married seven years ago to the defendant and lived at Payson My husband was convicted of unlawful cohabitation co-habitation and served a term in the penitentiary peni-tentiary We agreed to separato one year ago last September when he came out of the pen This was at Payson at a public gathering we made an agreement to keep the law I met the defendant upon the street upon my return from Beaver He never visited mo after that time Crossexamined This agreement was in September of 1889 and I have kept the law since that time VarianDo you no longer acknowledge him as your husband ANo sir Varian Do you repudiate him AYes sir When I married him I supposed it was for life I knew of the law at that time I have permanently determined de-termined to obey the law Maria Coombs testified Know Mr Harper Har-per Was at my fathers house when he t was living at my sisters house 1 never took meals to him Do not know of Esther doing so My sister does not live as the i wife of Mr Harper Ida CoombsDo not know who prepared I I the meals for Mr Harper while in Fannies house There was a dearth of evidence to convict con-vict and King for the defense asked that the judro instruct the jury to return a verdict ver-dict of not guilty to which the judge complied t com-plied and the vordict was so rendered Henry W Hales pleaded not guilty to the charge of unlawful cohabitation Andrew Nelson and Jens Hanson were admitted to citizenship The case of the United States vs Charles D Smitl for the crime of adultery committed com-mitted at Salina with Miss Hugentumble was taken up for trial Miss Anna Hugentumble took the stand Have lived in Salina for ten years Was Waa there in September last Am eighteen years old Know C D Smith Met him hina two years ago he is a drummer Met him at Kniehtons hotel Was doing a little of everything there Saw him in September 1SSO Had a child in April of last year The child died C D Smith is the father Was intimate with him in July 1SSP Have not been intimate with any one else This was outside of the town of Salina Was out with him once or twice before CrossexaminedLived at Knightons in July about the 24th Had known him about one year before I was about this time of the year at 7 or S oclock at night that the act was committed Did not keep company with any other man at that time Mary Gates Have known the girl that was on the stand for a few years Attended At-tended her as she was being confined in April of last year Saw the child Have seen the defendant at Salina Mary Knighton Keep a hotel at Salina Know the young girl She was at my house in July 1SS9 Know Smith He was at my house at the same time Have seen Smith In tho kitchen talking to the girl in a friendly way Mr Christiansen Know Miss Hugen tumble Was called to her bed whoa she was confined last spring Furgeson attorney for the defense moved for the acquittal the defendant as there was no coroborative evidence t r prove the position of the prosecution Varian contended that the territorial statutes do not govern in trials for offence against the United States but that the common law rule of evidence should be adhered ad-hered to and also assumed that there was corroborative evidence The motion was overruled The defendant was sworn and took the standI live in Salt Lake city Was traveling trav-eling for Z C 11 L in July Was at Salina Sa-lina once in the latter part of July 1SS9 Have seen Miss Hugentumble at Salina on the 29th or30th of July She was a cook at the house Was never with her alone while there Left for Gunnison on the following lowing day after my arrival Never walked out in the town with her or had any famill arity with her Am fortythree < years old Have a family and sixteen children The case was submitted to tho jury after a somewhat vigorous argument |
