Show AN ACT Providing For the Equalization of Territorial tnd Territorial School Taxes SECTION 1Be it enacted by the Governor Gover-nor and Legislative Assembly of ike Territory Ter-ritory of Utah That a Territorial Boare of Equalization of assessment of Territorial and Territorial school taxes is hereby created for the years 1888 and 1889 SEC 2Said board of equalization shall consist of seven persons all of whom shall be elected by the joint vote of the present Legislative Assembly Provided that not more than one member mem-ber shall be elected from any county exedt Salt Lake County which shall be entitled to two mambes Each member of said board shall take and subscribe the oath of office which shall be tiled with the Auditor of Public Accounts SEC BSaid board of Equalization shall meet at the office of the Territorial Auditor of Public Accounts in Salt Lake City at 12 olock noon on the in T of each and third Monday June eac year a majority of said board shall constitute a quorum to do business At the first meeting of said board a ohairman and a secretary shall be appointed from among their number SEC 4The county clerk of each county in this Territory shall on or before the third Monday in June of each year prepare and forward to the Auditor of Public Accounts for the use of the Board of Equalization a copy of a sufficient number of pages from the county assessment roll of his county to show at least two pages of the assessment assess-ment of property in each precinct of his county Said Board of Equalization is authorized author-ized to call upon thecounty clerk of any county for a copy of any further portion por-tion of the assessment roll of suh county whenever they may deem it necessary and the county clerk so requested re-quested shall immediately prepare a I copy of the pages of said assessment roll designated by said board 10 which shall be attached his certificate of the correctness correct-ness of said copy and transmit the tame to said board Said Board in the performance of its duty mayvisite any part of the Territory Terri-tory and shall also have power to administer ad-minister oaths by its chairman or secretary I secre-tary to summon to its aid the assessor of any county or any otaer parson and examine him or them under oath and also examine said copies of the assessment assess-ment roll in order to ascertain the actual ac-tual and assessed value of taxable property prop-erty both real and personal comparing one county with another Sic i5Said Board shall make such changes in the assessed valuation of the different classes of property in any county by increasing or decreasing the same such par cent as may be necessary necess-ary to equalize the assessment of such county with the assessment of other counties Provided That the county court of any county in which it is proposed pro-posed to increase the assessed valuation shall have not less than ten days notice to appear by representative and resist such increase SEC G The action of said Board of Equalization on the assessed valuation of the property in any county of this Territorv for the said years 1838 and 1889 shall be final The said board shall finish fin-ish its labors and file a full and completo report of all the changes made by it with the Auditor of Public Accounts on or before the first day of August of each year and invnediatel thereafter the the secretary thereof shall give notice to the county court of each county 01 the action of said board affecting such county SEC 70n receipt of said notice of the action of the Board of Equalization each county court shall cause said notice no-tice to be entered upon its records and if changes have been made by said board the county clerk shall thereupon enter such changes upon the assessment assess-ment roll by adding to or taking from the assessed valuation of the different classes of property in the county such per cent as such notice shall designate and give notice by publication in some newspaper having general circuation in the county and by causing a notice of such change to be posted in at least three public places in each precinct of said county SEC SThe Raid Board of Equalization Equaliza-tion shall furnish to the Legislative Assembly As-sembly the Territory within the first two weeks of its session a report of its official rpo ceedings under this act with such recommendations as it may deem proper SEC 9Each member of said board shall receive for his services while actually actu-ally engaged in the work of equaliza ion 5 per day and lOc per mile one way only and each person summoned as witness or aid shall receive 3 per day and the same mileage allowed to members the board SEC IOThe Territorial Auditor of Public Accounts shall audit the accounts I ac-counts of said Board of Equalization for per diem and mileage and draw his warrants for the amount due which shall be paid out of the Territorial Treasury and the sum of 5000 or so mnch thereof as
