Show A CASE OF NULLIFICATION The Ogdcn Commercial pronounced the recent action of the county court of that place a piece of nullification Our northern north-ern cotemporary has a happy faculty of using highsounding terms without as it I would appear at all times having a full mprehension of their scope and meaning The action referred to was the division of that town into precincts giving it four instead of one as formerly Under the law the court undoubtedly had the right to do this whether there was any pressing necessity neces-sity for it or not and we are at liberty to assume that there was occasion for the actor act-or it would not have been performed But taking the other view of it where does the nullification come in Instead of nullifying nulli-fying anything it looks to us more like expansion ex-pansion increased authority The Commercial Com-mercial man has doubtless read something of United States history and run across a passage where northern statesmen prior to tho rebellion resorted to the term in question to define the position of Joux C CJtLnous and his cohorts for the simple reason that a name must be found for everything and while that one was utterly inappropriate and unfitting it nevertheless satisfied tho budding abolition intellect and had to stand Now where let us ask is the resemblance between the strained quality of CAMIOUNS policy and the action of Weber countys fiduciary representatives That illustrious statesman states-man believed in technically and formally carrying out the terms of the original compact com-pact between the states by means of which each commonwealth would be sovereign and supreme within itself the same as individuals were sovereign and supreme of themselves so long as they did nothing to forfeit thqir rights the Weber county court does not say as much there being no C VLUOUV nowadays even if there were any disposition to imitate him It simply decrees that there are too many people in one particular place for a precinct pre-cinct according to the scale of apportionment apportion-ment which obtains elsewhere in the territory terri-tory and thereupon it proceeds to make as many magisterial divisions as in its opinion the numbers call for This is peculiar nullification truly It would seem if the record were scanned closely and the files of the Commercial Commer-cial referred to in that connection as though though there were another form of nullification which contained something of substance as well in the burg en the Weber Gaining the notes and confidence of the people under specific promises to door do-or not to do certain things is more than a promise is a contract It is the only consideration con-sideration which under the laws we can property give for ballots and the law not only marshal law but maybe the office dictionary was loaned out at the time and thus what would have been the fine effect of a pun was measurably if not altogether alto-gether destroyed Now in view of the fact that the raid referred to in such indirect indi-rect terms was one in support of the law and that those who support the Commercial took it upon themselves to do that very thing and failed to do it or come anywhere near it is not such an insinuation somewhat some-what in the nature of nullification And since it once more brings vividly before us the fact that there is or was gross dereliction derelic-tion of duty in the metropolis of Weber county and that too by the very men through whose success at the polls that papers existence was made possible does it not seem as though it were doing a little in the nullifying lino itsolf The number of tho paper referred to goes on to say a word to Ogden Liberals and the council There has been a disposition disposi-tion it says to be too lenient The police po-lice have not at all times strictly enforced the orders of the council and their chief The council has to this extent been compelled com-pelled to shoulder the blame for a non enforcement of the law The council and police board have given orders but they were not executed The police by their failure to act have placed the city authorities authori-ties in disrepute when the increased in vigor The council must not leave a bar down Let it not be said there is need for martial law and above all do not tolerate it But here is the cap sheaf See that Ogden does not become tho resort for gamblers and lewd women Salt Lake has Keep it pure and keep the government in your own hands We would ourselves suggest that a modification mod-ification so much as to bring the Ogden ol the present down somewhere near to Salt Lakes plane of morals would be an improvement im-provement not to be despised That it is not so is nullification on the part of those in charge of the offices there And then above all why does a Republican paper object ob-ject to federal control in municipal affairs I It is a tenet of the Republican gospel that not even states let alone municipalities have any rights which the general government govern-ment need respect whenever it sees fit not to do so For a shield of the faith of BEX JAMIX such language such objections are seditious treasonable
