Show r I r It A PRISONER EEIilPEISONED Joseph Davis Found Guilty of Stealing Ilia Guards Weapon Joseph Davis a Penitentiary bird was yesterday on trial in Judge Zanes court on the novel charge of having stolen a gun belonging to the United States from a guard whom he tripped up in escaping from Davis was within a mouth and a half oi the time when he was to have been released but becoming enraged because of a seventytwo hours imprisonment in the sweat box as he alleges unjustlyhe determined to idake his escape Accordingly when heand another prisoner named Taylor and a guard named Williams were working work-ing in the field one day outside of the Pen he and Taylor tripped Williams up seized his gun made off with it and made good their escape Taylor has never yet been C recaptured but is known to be in a certain part of Nevada Davis reached San Francisco Fran-cisco where he engaged in bis old business oflather and plasturer he fell in with a former pal from Fort Bridger who he says betrayed him to secure the reward offered 100 Davis was brought back to Utah and probably considered that he had only toserve out the remainder of his time and it was with hu disgust that he learned some time afterwards that he had been in dicted for stealing the guards gun which he had thought necessary to take along to prevent himself being shot after He was found guilty yesterday by a regular jury though Mr S H Lewis his lawyer made a strong and somewhat ingenious fight for him He will be sentenced Thursday morning Ir is a pity said Judge Zane to a HERALD reporter after adjournment that there should be no provisions for labor within penitentiary Had there been in this instance the man Davis need not have escaped the country would have been spared the expense of bringing him back and trying him and he wouldhave avoided serving another term in prison |
