Show J If ATTTjIC 4 WQXjL R BURT 3IAKIJS i AXjuJ lYJiEv Be Intended No Disrespect to the Court in MaulIng Collin This morning at 10 oclock Andrew Burt will appear before Judge Zane to show cause why he should not t be punished pun-ished for pounding j the jCpurls special pet DeputyCollin Burtbrasfiled the the following answer lo I Suage L c Zanes order Initl1e states asiwe intimafed he would that he mauled Collin in his capacity as an ordinary mortal not as a deputy marshal In the District Court forjthe Third Judicial Judi-cial ct Ufah Territory < P In the matter pf the ntjenfpj oAn drew Burt in obstructing an officer of this Court while in the discharge of his duty Answer of respondent To the said Court The said respondent respond-ent Andrew Burt for his answer to the charges contained In the affidavit of C S Varian and the rule of this Court requiring re-quiring respondent to show cause why he should not be adjudged in contempt thereof says upon his oath That at thejhme and place mentioned in said affidavit as the time and place when and where the matters and things constituting the said alleged contempt odcdriedthe respondent was totally ignorant of the nature of the business upon which Henry ColluPwas engaged and did not learn what it was until sometime afterward That respondent did not know that said Collin had a subpoena from this Court to servethat he was serving a subpoena or that he had seryed a subpoma until afterward as above stated That if said Collin served a subpwna respondents presence pres-ence Collin was not interrupted hindered hin-dered or delayed in the discharge of said duty nor was he obstructed in anyway any-way or at all before or during such service ser-vice by respondent Respondent denies that while said Collin was engaged in the discharge of his duty aforesaid or of any duty enjoined en-joined upon him by this Court respondent respon-dent assaulted beat and wounded him and did thereby or at all hinder or delay him in the attempt to so discharge said duty and denies that he did unlawfully unlaw-fully or at all interfere with the piocess or proceedings of this Court or that he had any intention whatever of doing so and denies having any intention Tvhnfptrpr nf hrinmncr the fidministrn tion of the law into derision and contempt con-tempt and does not believe that anything any-thing done by him at said time and place had any such manifest tendency as is alleged in said affidavit Respondent affirms that a difficulty occurred between himself and said Co lin in which blows were delivered by respondent but that he was provoked so to do by said Collin and acted as he beieved at the time partly in self defense That this was after said sub aoonas had been served and while Collin was on the street that the difficulty between them was entirely personal in its nature and had no reference whatever what-ever to this court its officers or proceedings pro-ceedings that respondent was arrested by a policeman for said transactionwas tried and onvicted by a justice of the peace and fliyyl 2nand costs all of TrUIoU rrcrti paid and ho was tluSiwipon discharged Respondent affirms that prior to and during said transaction and all the time he has held this court its officers and process in respect and tHathe still so liolds them that he regarded said Collin apart from his official duties and on the streets the same as any other citizen and having a grievance sought to adjust it not with the official but with the person and that he had not and has not the least intention or desire to be in contempt of this court or its authority any manner whatsoever or at all Wherefore respondent prays to be hence dismissed without condition ANDREW BURT |
