Show NO FIILTllELLGHT All Stories Told by the Wit i nesses AgreeI I MANNEROF GARDNERS DEATH Five Witnesses Examined Yesterday and the Examination Still Drags its Slow Length Along The second day of the examination of Neilson and Hill was opened at the City Hall yesterday morning Judge attorneys at-torneys prisoners and spectators all being in their places Neilsons manner as it has ample cause to be is by far the more concerned of the two He is a young Swedish blonde with the pronounced pro-nounced face of the Scandinavian Hill is even younger in appearance and is a trim built thoroughly goodlooking young fellow but with the slight traces of dissipation beginning to be evident in his manner The witnesses were again excluded and the examination was opened by the calling back of the first among their number GEORGE REDMOND was sworn and testified tes-tified I am 25 years old I have lived in Mill Creek about seven years and have knqwn Gardner about four Hill aboUt six and Neilson about two I was at Pitts Gardens on the night of December 18th There was a wedding party there and I came in at about 830 remaining until12 or 1 oclock I saw Henry Gardner there at about 9 oclock Witness drew a diagram of the rooms in Pitts house 1 saw Hill and Neilsen there Hill drank with me Gardner was the worse for liquor and so I should judge was Hill Neilson seemed sober to me I took Miss I Phillips with me I heard Hill and Gardner talking about their horses pulling the next thing I saw was that Hill had knocked Gardner down he fell in the doorway with his head westward west-ward I saw Neilson come from the bar and kick Gardner three times on the head and chest he kicked him pretty pret-ty hard this way describing it After Hill knocked Gardner down Hamilton caught hold of him and held him back they all went out of the door pell men in a crowd but I didnt see who pushed them the next I saw was Henry Gardner Gard-ner standing outside wanting to come inI did not hear him say anything about his hat he was not more than to or three feet from the steps of the I porch and Mr Neilson was on the porch hcsaid U Keep back or Ilmake youP I Gardner made a step to come in and Neilson kicked him in the abdomen he crossed his hands across the abdomen abdo-men and leaned over groaning I think i Hill and Hamilton had gone back into the saloon I did not hear the sound of the kickbut I judged it was a pretty hard one he kicked with the rightfoot I went in then and saw no more of I what Neilson did The cross examination elicited nothing noth-ing fresh upon the case WILFORD W LUCE testified to much the same state of things as the previous witnesses Nothing new was brought out except that he saw Neilson do no I kicking while Gardner was lying in the r house Luce saw Neilsoa push the two men outside and saw Gardner helped into the wagon but did not see the kicking The crossexamination conducted by Mr Van Home gained nothing material ma-terial from the witness REUBEN BAILEYS examination elicited one or two points not previously brought out He stated that when Gardner came towards the porch after having been pushed out eilson aid You gentlemen go in and attend the dance then to Gardner Youve created disturbance enough I want you to leave here Gardner said he wanted his hat Niel son said he would send out a boy with a lantern but Gardner came on and Nelson kicked him in the abdomen Gardner doubled up and said Oh God you treat me like a dog The crossexamination also failed to shake the testimony of this witness DANIEL LUNN and HENRY L GREEN were the Only other witnesses examined before the time for the adjournment arrived Nothing of any importance was elicited from either of these and the examination adjourned until this morning morn-ing at 10 oclock where it is expected that one of the Gardners or one of the physicians will be questioned I |
