Show U P and Government New York SThe attention of r counsel of the Union Pacific having been called to a Washington dispatch I dis-patch stating that the secretary of the interior recommended the attor neygeneral to bring suit against the I company to recover 100000 under the Thurman act Sidney Bartlett and Judge Dillon authorized the I following statement Government claims no such amount and proposes an amicable settlement of the disputed dis-puted question The controversy between the Union Pacific and United States relates to the manner ill which the net earnings under the Thurman act shall be ascertained The company under the advice of counsel and under their construction construc-tion of the decision of the supreme court claim to have the cost of new construction and equipment on the main line deducted from the gross earnings in order to ascertain the net earnings The commissioner of I railroads does not concede this claim and both rjarties de siro a judicial decision thereof and an amicable suit to that end is about to be brought with the government gov-ernment and under its construction construc-tion claim is due it of 8961837 The company claim that they owe only 306477 The company com-pany has not paid this because it has a counter claim against the United States for over 1500000 The company has brought suit for postal compensation and the Supreme Su-preme Court recently decided in favor of the company and against the principles claimed by the postmaster post-master general and the amount due the company is awaiting a judicial determination of the companys claim against the government for I postal services which is much I greater than any claim against it under the Thurman act Tho com panys purpose being when both disputes are adjusted to set off one against the other Officers of the government have made no complaint com-plaint of the course pursued by the company but have judicial settlements settle-ments of the case at issue |
