Show spirE It was expected that the judge of the DittrictCourt would do with the Robinson Robin-son murder case yesterday as he did with the Potter aflair a few days ago namely compel a trial of the aecused The indictment was found nearly three yeara ago and some of tha defendants have been under arrest ever silica They have at nil times been ready and anxious for a tria1 the postponements from term to term being successively granted on the application of the public prosecutor It ia pretty generally understood that the indictment was based upon uncorroborated assertions ol a t thoroughly irresponsible and notorious vagabond whose word is not entitled to consideration It Lai always been a little strange that ft grand jury would entertain EO serious a charge preferred by such a person Prejudice Preju-dice on the part of the jurors must have guided them more than the testimony tes-timony They may have hoped that evidence would be discovered afterwards after-wards and it seems the court is similarly afflicted If there were probable cause for believing in the guilt of the accused or the faintest hope existed for a conriotion in the dim future the act of refusing them It a trial would not have worn ha look of a spiteful attempt to fasten a stigma upon their names This little exhibition of spite work was expected from Mr VsnZile who long since showed that he had no appreciation of right or justice where his per eonal prejudices were allowed to exert themselves aa they evidently evi-dently have done in this case but better things were looked for from the chief justice who is presumed to be above these unworthy manifestations manifesta-tions of class hatred So far as the defendants are concerned con-cerned the dismissal of the indictment indict-ment will bave the same effect as an acquittal by the jury Their acquaintances acquain-tances and friends have never believed be-lieved them guilty of the horrible brutal murder charged against them and despite the manifest purpose of the prosecuting officer in opposing a trial to throw around them a shadow i of guilt the community will Icox upon S the discharge as a vindication and an acknowledgment on the part of the prosecutor that the defendants were I wrongfully accused It is not probable prob-able that any other attempt will be made to trouble them and we all hope the day of picked and packed grand juries is over |
