Show CITY COUNCIL Proceedings at tbe City Council on Tuesday evening November 9 1880 Alderman Sheets presidinz A petition was read signed by Adam Bpeirg and eight others constituting consti-tuting a committee appointed by the residents and land owners of the First Sacond and Tenth Ware of the city which represented tbat tbe people ol said wards held exclusive control of the waters of Emigration Creek for I culinary pnrpoiea and irrigating their city lot since the spring ol 1849 cty bat in the year 1868 one H H Harris and other parties settled and took up farms on toe bench south of the Inane Asylum outside of the corporation limits and used the surplus or waste waters upon said farms That said parties loon after petlcione the City Council for a por ion of the creek which was denied them as there was barely enough water when in a low stage for the city WArdn and that although they petitioned Wr twice more they were cads time refused by the Council Tbat the said H H Harris and others dur the ing the past eummer petitioned water commissioners ol Salt Lake County for onehalf of Emigration Creek and that although the original owners of the waters proved their right thereto the said commissioners commission-ers decided that the farms should have oneseventh of tbe whole stream thereby depriving the inhabitant of the ward aforementioned afore-mentioned of vetted water rights which they hd enjoyed unditputedly or eighteen years As Salt Lake City corporation was directly interested inter-ested by owning one block the Tenth Ward Square which draws its supply J water from said stream and indirectly indi-rectly interested m protecting her citizens in their water rights and in keeping water owned by the citizens from being divarted out of the corporate corpo-rate limits op to farming lands the petitioners respectfully asked tbe cooperation co-operation of the Council in any further proceedings that might be necessary to protect them in their rights to the me of said water Referred to the committee on irrigation irri-gation T B Joneiof the Fifteenth Ward petitioned that the lence crossing the sidewalk which adjoins his property at the wtet end of First South street which fence was ordered by the Coon i to be removed on or before November Novem-ber let be allowed to remain and that this time for such removal be tx ended unforeeen circumstances haying hay-ing rendered i impossible for him to comply with tbe requirements of the Council within the time allotted Laid on the table A B Taylor presented a commu ication in regard to the purchase of and described m hi petition of Oo tabor 26th The loud desired was nol and ever had been vacant and i unproductive and Mr Taylor proposed pro-posed > to make material improvements upon the land to that it would become be-come I source of revenue to the city as well as a benefit otherwise and if tokens of good faith were required be ould be willing to take an agreement agree-ment from the city cppcifyitu that the improvements should be made prior to the deed for the lana being given and that a right ot way over the land to Ensign Peak be re tamed by the city Referred to tbe I committee on public grounds Tbe committee thereupon asked an expression from the Council of its views as to whether the corporation should dispose of its lands held for I the public benefit t private individ ual After discussiau I was decided de-cided to be the sense of the Council that no lands in that vicinity bo sold t any person but that they be re served for tna benefit of the public A petition submitted from John erbst and thirtyieven other reel dents of Big Cottonwood and Mill reek Wards and interested in the route of the Jordan and Salt Lake CIty Canal asking the Council to reconsider consider the resolution adopting the upper line ai the route for said canal The petitioners endorsed instead thereof the lower line or the old Church Canal which was already ex Cat d to a contiderable extent and endangered ao house while on the upper > route south of Mill Creek the line for a long distance runs along a louse sand and springy sidebill ea angering the safety of tbe houses immediately below A remonstrance to this petition gned i by E H Williams and jirty eiiht others citizens ot Mill Creek aDd Cottonwood Ward and owners of a water ditch known as the Lower anal was also read proteting eainst any change or re miiJeratiou of the route now adopted by the Council for the canal referred to The signers of the remonstrance set orth Ibat they were the owners of the lower canal and had used it a9 Rater R-ater ditch to convey the waters of the Big Cottonwood t their farms for the past eight yean and that they did not wish nor did they intend to be molested in their rights They called I attention also to many of the names attached to the petition for reconsideration deration and stated that they were non Owflere and had no claim or rights whatever in the lower canal After remarks by gentlemen corn pOling I committee appointed by the citizens of the wards aforementioned who were in favor of the remon rance both petition and remon I ranee were referred Ic t the committee com-mittee on improvements and Aldermen Alder-men Pyper and Raleigh were added thereto for the consideration of this matter The committee oa improvements to whom was referred the petition of Wm Varley in reference to Wm Jennings J Bon agents for the > jpont Powder Co storing powder in a house belonging Joseph Burns sIc reported that they had visited the place and found that the powder is not at present in a very safe place but > that it was the understanding that i should only remain there a few days while they are rebuilding their magazines The committee recommended however that the city marshal require the agents of the oowder comnanr aforesaid to place a fuar over the bouse until the powder pow-der is returned to the magazine Adopted Toe committee on construction of the City Canal reported that 3 of each year shall be set apart to the sinking fund created to provide for the payment of the interest and principal of the bond issued in pursuance of the resolution aforesaid the amount to be fet
