Notice is hereby given, pursuant to Section UCA 1953, that on the 20th day of June, 1978, at 3:00 p.m., in Room 108, Davis County Courthouse, this dinance, it shall be unlawful for any person to install or have installed an individual waste water disposal system or a small underground waste water disposal system in an area where the maximum anticipated ground water elevation is higher than a depth of five feet in the area where the absorption is system be built, as proposed to measured from the existing undisturbed ground level during the high ground water cycle. 2. Such areas may be made suitable lor waste water disposal sysif all other tems, requirements are met, by properly designed and maintained surface drainage systems and filling. Plans for water disposal systems must be reviewed and approved by the Davis County Health Department, Environmental Health Division, and the Davis County Engineer. 4. Definitions: MAXIMUM (a) Farmington, T of the provisions ot tms AN- GROUND ELEVATION WATER means the highest point to which subsurface water rises during any season as a water TICIPATED table. (b) INDIVIDUAL WASTE WATER DISPOSAL SYSTEM" means a system for disposing of domestic waste water from an individual home or from a multiple than four individual family units, or from a small commercial installation serving not more than 50 persons per day. It consists of a house sewer, a septic tank, and an absorption system. UN"SMALL (c) WASTE DERGROUND WATER DISPOSAL SYSTEM" means the same type of system as described under "b above, except that it is designed to handle a large volume of domestic waste water which originates in business, commercial, institutional, and similar establishments. (d) "POLLUTION" means such contamination, or other alteration of the physical, themical, or biological properties of any waters of the state, or such discharge of any liquid, gaseous, or solid substance into any waters of the state as will create a nuisance or render such waters harmful or detrimental or injurious to public health, safety, or welfare, or to domestic, commercial, industrial, agricultural, recreational, or other legitimate, beneficial uses, or to livestock, wild animals, birds, fish, or other aquatic life. (e) WASTE WATER" means sewage, industrial waste or other liquid under the ground pollution of waters of the slate (f) ABSORPTION SYSTEM" means a device con- structed under the ground surface to receive and to distribute effluent in such a manner that the effluent is effectively filtered and retained below ground surface. (g) PERSON" shall mean any individual, firm, partnership, association, corporation, company, governmental agency, club, or organization of any kind. 5. Any person violating any Or- dinance shall be deemed guilty of a Class B Misdemeanor; and upon conviction shall be punished by a fine of not more than $299.00 or by imprisonment of not more than six months in jail, or both. 6. In the opinion of the Board of County Commissioners of Davis County, this Ordinance is necessary for the peace, health, and safety of Davis County and the inhabitants thereof. Therefore, this Ordinance shall be effective upon its passage and upon a copy being published in accordance with law, and a copy being deposited in the office of the Clerk of Davis County, Utah. All persons interested will be heard.
