J. Reese Hunter Editors Outlook - Why We Oppose Proposition -- .1 J. Reese Hunter Those who want to destroy our form of government tricked the people into voting for the Gateway Amendment in a previous election. The people were promised that the Gateway Amendment would allow them to have better government by being able to amend the state Constitution in wholesale lots rather than one subject at a time. The present amendments being placed before the voters at this election have shown the justification for our fears when we voiced opposition to Gateway two years ago. This same group of people previously worked hard for annual sessions of the legislature. Most people think we have too many laws now, so they tricked the people into thinking that the session in years would only be budgetary so that government could be better managed. What they were really after was to get their foot in the door by getting people to accept the idea of annual sessions. They did not refer much to the fact that even that bill allowed the legislature to consider other things so long as they had a 23 majority. Therefore, we have had the spectacle of the legislature being degraded in the eyes of the people because, even at the first budgetary session, the legislature considered matters and the people then knew they had been even-number- non-budgeta- legislature to have the power to hire its own independent legal counsel. They want someone beholden to them and not to the people. Plus, you can count on more expensive government and more taxes to pay for it, since attorneys do not come cheaply. 2. You will be voting to dilute the office of State Auditor since this proposition would allow the legislature to hire its own auditor. Actually, the State auditor can now do any and all things pertaining to auditing that one hired by the legislature could do. Again, they want an auditor answerable only to the legislature and not to the people. This simply compounds government upon government thus costing more tax money. 3. You will be voting to increase the cost of government since the legislators will get paid for each day they are involved in interim committees. These committees meet between sessions of the legislature. Actually, we could be better off if they did not meet at all. At least, by not paying them, they will keep these meetings to a minimum. If they are paid, it will be one further step toward year-roun- d sessions of the legislature. Again, more cost to ed ry deceived. - Now, it is time for the 1972 trick to be foisted upon the people. Once again, we are being told how much better our government is going to be if only these amendments would be adopted. Again, they are using deception as their modus operandi as they try to further destroy the basic foundational policy of our government which is, in a nutshell, That government is best which governs least. After reading the first proposition to be voted on in November a question popped into mind, namely, How many people who read this will understand what they will be voting for? Remember, it is the lawyers who put these things together and even they do not know what they are saying (that is evident by the number of hours they spend in haggling over the finer points of the law). The Utah Independent wishes to outline some of the things you will be voting for if you vote in favor of Proposition No. 1. 1. You will be voting to allow the legislature to hire its own attorney who will not be answerable to the people but to the legislature only. You will be voting to upset the governmental balance of power between the Attorney General's office and the Legislature. This proposition would allow the legislature to hire its own legal counsel who would be answerable only to the legislature. This diminishes the power of the Attorney General who is answerable to the people. He already has the responsibility to provide what legal services may be required by the legislature. You will be voting to further emasculate or destroy our state sovereignty since this will allow the legislature, Notwithstanding any provision of this constitution, to impose income taxes by whatever amount it defines and by reference to any provision of the laws of the United States including the changes that may be made by the federal government from time to time. They are getting the voters of Utah to legalize the collecting of our state income taxes by the federal government. To have the federal government collect taxes, they wrote into the current Revenue Sharing bill that the state government would have to have its tax provisions' in line with the federal. Even in the collecting of taxes we would help to break down our form of government with the passage of this proposition. Now that the federal government will be giving the states money through Revenue sharing the next step is for the federal government to also collect it. This proposition opens the way for that to happen. 5. Proposition No. 1 omits section 26 of our present Constitution altogether. That section prohibits the state government from enacting special laws in 18 different areas! This proposition will simply allow the government to move into areas previously prohibited by the Constitution. Again, this works against the people. 6. Proposition No. 1 will also allow our legislators to pass more laws since it is designed to cut down the time. Remember, we do not suffer from having too few laws. Evcrytime the legislature meets several hundred more laws are put on the books. Practically every move we make today is governed by law. This would allow the legislature to only read the title to bills, rather than the bills, three times. Many of the legislators do not read the bills, themselves, even now. It would be a shame to deprive them of the privilege of having it read to them. Furthermore, this proposition would allow the presiding officer of each house to sign the bills within five days instead of in the presence of the house over which he presides. We do not need to speed up the passage of bills. If anything, it needs to be slowed down. It is evident that the passage of Proposition No. 1 will be to the detriment of the people in general. Those who are reaching for more power over us would be happy to see the people put their necks in the noose by having this proposition passed. Let's not be tricked again. For economy in government, for ; maintaining the proper relationship between state and federal government, for maintaining more control over a government that is fast gaining more control over us, the UTAH INDEPENDENT urges a NO vote on Proposition No. 1.
