notifying the council that it had passed H F 17 a bill for an act amending sections 91 92 and 93 of chapter 9 of an act revising proceedings in justices courts and providing for ap to district courts in criminal cases the bill was read by its title and referred to the committee on judiciary the council was notified eliat the house had passed H F 38 a bill for an act defining the manner of determine ting disputed county boundary lines head by its title and referred to the committee on counties the council was informed that H F 25 a bill to amend title 12 chapter 2 section of an act revising the code of civil procedure of utah territory relating to the district court bead by its title and referred to the judiciary committee A communication from the house was read advising the council that it had passed H F 41 a bill to amend section of the code of civil procedure the bill was read by its title and referred to the judiciary committee the committee on private corporations to whom was referred C F 21 a bill for an act in relation to banking recommended that the bill as amended by the committee be put upon its passage adopted and the bill filed for second reading the committee on judiciary to whom was referred H F 16 a bill to amend chapter 26 of the laws of 1880 returned the recommendation that it be placed upon ita passage report adopted and the bill filed for second reading the same committee to eliom was referred H F 43 a bill amending section of an act revising the civil procedure of utah territory recommended that the bill as amended by the committee be its the report was adopted and the bill filled for second reading mr smoot introduced 0 F 22 a bill for an act for alie protection of fish and game the bill was read for the first time by its title and referred to the committee on fish and game H F 16 a bill to amend chapter 26 of the laws of 1880 punishing persons entering railroad cars in certain cases was then passed under a suspension of the rules the judiciary committee to whom was referred the communication of the auditor in reference to the necessity for amending section 2 chapter 7 of the laws of reported the following bill which was read for the first time and filed for second reading it is as follows SECTION 1 be it enacted etc that chapter 7 laws of 1886 be amended to read as follows the money shall be drawn from the Treasury of the territory by the warden of the penitentiary for said prisoner upon a warrant issued by the auditor thereof provided that of said money the warden shall expend atlease at least 10 in the purchase of clothing for said prisoner the council then adjourned HOUSE after the usual preliminaries the speaker arose and said before proceeding further he haj a communication to make to the house the utah central railway asked that he intercede for them in securing the release of the chief clerk owing to the fact that the railway company desired his services in connection with the extension of their road coast he therefore now offered his resignation mr king then moved that a committee of three be appointed to canvass and select a suitable person to fill the vacated position chope name should be presented to the house today to day tiie chair named massre king moyle and farsworth as the committee richards H F 24 a bill to prevent crimes against the elective franchise was slightly amended and passed mr hatch presented five petitions from various parts of the territory praying for the passage of a local option law referred to the committee on election mr creer presented four more petitions in relation to the same matter reference mr hatch presented a petition signed by a large number of prominent gentlemen of salt lake city calling attention to the growing need there is to establish a territorial fish hatchery where desirable fiech may be propagated for replenishing the streams of the territory and for the appointment of a territorial fish commissioner it ia needless to add they say that nearly every state in the union has its hatchery and commissioner and that fish are being successfully hatched in countless numbers at a nominal cost compared with the intrinsic and commercial value of the fish food product and after enumerating the vari ties of fish that could be successfully propagated in utah streams say with the liepe that your honorable body will appropriate for the establishment of a territorial hatchery for the indicated above and that you will appoint a fish 10 superintend and developed dev elope the fish grow ing interests of alie territory in duty bound your petitioners petition ers will ever pray it is signed by J R walker S P F auerbach bro john and a great many others mr farnsworth presented the claim of sheriff baldwin of beaver county for it was referred to the committee on claims and public accounts mr bouche from alie committee on agriculture and irrigation to whom had been referred H F 44 a bill providing for the bill for nn act amending section 1105 title 8 of eminent domain of the laws of alie territory of utah committee on agriculture and irrigation H F 27 the bill in reference to barb wire fences again came up it once mure invoked considerable discussion after a lengthening debate alie bill waa put upon its passage an passed by a vote of 16 to 6 it is in full below SUCTION L be it enacted ac that all persons hereafter constructing or causing kcf be constructed barb wire fences in this Ter ferrity rity aro hereby required to make them of at tightly suspended from substantial i hobt firmly set in the ground not more than eighteen feet apart provided that i bucha pole or hoard in lieu oi vire shall be deemed a compliance with the provisions of this section SEC 2 all persona now owning barb wire fences in this territory are hereby required to make them conform to the provisions of the foregoing section within six months after the passage and approval of this act sac 3 barb wire fences when con strutted ted or maintained by any person in this territory shall be kept by the owner in good repair and substantially in the condition prescribed for the nal construction thereof provided that nothing in this act shall be constructed as applying to cross or inside fenced except when said fences divide the lands of different owners SEC 4 any person wilfully and negligently li failing to comply with the requirements quire ments ot this act is guilty of a misdemeanor andis liable for all damage sustained by the person injured A communication from the governor enclosed a petition from
