Show ANOTHER BOMBSHELL JUDGE zane A bistier IX aie the receivers attorneys smell a mouse and object yesterday afternoon says saturday evenings beius before judge E T sprague two moro witnesses M kirkpatrick and 0 W bennett bied as to the amount of compensation they thought the attorneys for the receiver in the suits for the charch property should have for their years services these witnesses also were of opinion that each or ia all was not too much it was admitted however that their firm did not receive half that sum in the D H G cases where the amount involved reached into the millions the compensation claims have been so unusually larga as to attract general attention one prominent attorney suggested they think they have a fat goose to pluck and dont mean to leave any pickings the detate of things created considerable interest especially among of the bar and tho session of the territorial rit orial supreme court at which the examiners report was expected to be made was well attended this forenoon chief justice sandford and associate justices boreman henderson and judd were present considerable time was consumed in reading the minutes of the last session as tho decree of tho court in the church cases were entered in ar tenso thia concluded S P brown of colorado and B W young of this city were admitted to the bar on taking the prescribed oath P li williams asked for the report of the examiner in regard to the compensation and accounts of tho receiver and his attorneys in the suit of the united states against the church of jesus christ of latter day saints he said that so far as the receiver and his attorneys concerned they prepared for the report Pi strict attorney peters arose and stated that ho was not now appearing for the government in the case but for the receiver he had requested tha attorney general ot tho united states to send some one to represent tha government and that official had designated district attorney hobson of colorado but mr hobson had bean too busy to come mr peters therefore asked a postponement of the date of making the refa raes report mr young joined in tho report for delay for the church attorneys to look at the Boce ivera accounts at this point audgo zane arose and asked leave of the court to appear in the case the schools of the territory were interested in the disposal of the church funds es cheated to the government the united states had no representative here to care for it interests and he had baen employed by the trustees of various school districts to appear on their behalf and etain their claims the judge had been employed just as he was coming into court therefore ho had not made his application in writing the law baya that the church property confiscated shall be disposed of by the secretary of the interior and the proceeds thereof applied to tho use and benefit oi the common schools in Territory tha in which such property may be this being the case the school districts had a right to be heard ia their own interest P ii williams said he thought the school trustees had no more right to be heard than did tho mini stera of various denominations or the city council of salt lake city the at boniey gameral of the united states had appeared unconcerned in the matter and had no representative present mr williams could therefore see no necessity for a postponement on grounds stated by mr peters As to the schools of the territory they were entitled to certain proceeds if the ans es cheated then the funds wore to be distributed by the interior department ho therefore opposed any stops leading to a delay in the examiners examinees es report judge sandford mr williams you are connected with the school interests of tha territory commissioner of schools I 1 think ho v many school trustees are thoro mr williams about 1000 I 1 could not give the exact without reference to my records but there are avor school districts and each district is a distinct organization with tareo trustees court we will hear judge zones petition on behalf of tho school districts il be will put it in writing the case does not appear to bo ready and the court will give further time judge zane will prepare his claim in writing BO we can consider it judda gilchrist suggested that judge zane be permitted to come in for all the trustees BO that the mattor could be decided for all at once coart if these 1000 trustees desiro to come in and present their claims we will consider that point wo will give till next saturday the for a further hearing of this mattor meantime the cou rt will take a till p m when critchelow and varian will act as an examining on applicants for admission to the bar when mr peters made the announcement no that he waa not counsel for the government but for tho receiver it caused a buzz among the attorneys but when judge zane asked leave to appear for the schools grow decidedly interesting williams and peters looked at each other and the glance indicated that they were not at ease under tho proposition one attorney leaned want a hand in this if judge zane gets in he will make that business feel pretty sick and thero will be some tun altogether there may be some interesting features bo fore tho case closes up |
