Larkin .against the Saltair Beach company, in which they obtained a verdict for $6,500. Roy E. Larkin, the son of the plaintiff, was drowned in the Great Salt Lake. He went in bathing at Saltair beach and drifted Mo-Cre- a ld out a long way and perished. The action for damages was founded on the allegations that the Saltair Beach company had not taken sufficient precautions for the safety of its patrons by designating the deep water and did not confine bathing to a certain area and that when the lad was missed the companys servants did not take energetic means to search for him. This point of the 11a bility of owners of bathing resorts is a new one in Utah and the divid.ng line between diligence on the part of the company and contributory negligence on the part of the patron has not been drawn. It is quite a feather in the cap of Price & McCrea who when they first filed the suit were laughed at by many attorneys of standing as foolish young men for supposing they had a case at all.
