Show ALIAS. SUMMONS-IN THE DISTRICT COURT OF lO the First Judicial District of the territory terri-tory of Utah, Utah county. Edward Morgan, plaintiff, vs James Weber, defendant. The peonle of the territory of Utah send greeting: To James Weber, defendant. You are hereby required to appear in an action ac-tion brought against jou by the above named plaintiff, in the District court of the First Judicial Ju-dicial i-istrict of the territory of Otah, and to answer the complaint filed ttierein, within ten days (exclusive of the day of service) after te service on you of this summons if served within this county: or if served out of this county, but in tiUs district, within twenty days; otherwise wittrin forty days or judg-meni judg-meni by default will be taken against you according ac-cording to piayer of this complaint. The said action is brought to obtain a decree de-cree of this;court forfhe foreclosure of a certain cer-tain mortgage described In the complaint an i executed by the said defendant on December 22, 1891, at Scotield. Emerv county, Utah, whereby defenaant promised to pay on or before be-fore the 1st day of April, 1802. the sum of $288.00 with interest at 10 per cent, per annum after maturity. That on April 1st the sum of $100 00 was paid and the further sum of $45.00 was paid on the 5th day of December, 1802, and thjre now remains the sum due of $157.00 with interest at 10 per cent, per annum from December 5, 1892. Wherefore pl-untiff prays judgment fcr the sum of $157.00 together witn interest thereon at the rae of 10 per cent, per annum from the first day of April 1892, and the further sum ol iM.OO attorney fees "and for costs of suit. That the usual decrte may be made foi the sale of snid premises by the sheriff sher-iff of Car ;on county. Utah territory, according accord-ing to law and the practice of this court; that tiie proceeds of said sale may be applied in payment ol the amount due to plaintiff, and that said plaintiff may have judgment and execution ex-ecution against said defendant for any deficiency defi-ciency which may remain after applying all the proceeds of said sale of said premises properly applicable to the satisfaction of said judgment. For fuller particulars reference Is hereby made to complaint on file. Ana you are hereby notified that if you fail to appear and answer the said complaint as above required, the said plaintiff win apply to the court, for the relief therein demanded, and costs of suit.
