In March last Mr. Hopkins gave property valued at to found a free hospital for indigent tick, connected with which is a training schc ol for nurses. He also made ample provisions for colored urphaus, and set apart 15,000 shares of Baltimore and Ohio railroad stock, valued at over $2,000,000, to found a university on his Clifton estate. A constitution and bylaws were adopted, and resolutions were also adopted against special privileges, asking more themselves than they are willing to grant for other industries; denouncing trickery, bribery and corruption in elections; favoring equal and just taxation; calling upon the State to give its children a moral and liberal education; acknowledging the rights of woman by admitting ber as an equal in the order of demanding justice and economy in publio affaire; ahd recommending the order as a bond of union stronger than armies. There were fifteen or twenty , Granges represented. , " . JNew lorlt, 'iit At the conclusion of Houghton's argu Hall's ment for defence ' in trial Tremaine commenced for the prose cution and in course of ins argument called the attention of the Jury to the fact that the defendant himself, when District Attorney, procured the conviction of Judge Bogart for an act similar to that for wbich he is now on trial, and then argued that the word "corruptly," was a mere surplusage, that the word "wilfully"' meant inteutionally and, that whatever his good taith, if he intenoed to do a forbidden act, be was doing it wilfully. In that position the court Tremaine spoke for sustained him. three hours, and concluded by saying, that if the offence was a mere technical one the jury should so find, and trust the court to administer a trifling technical penalty. He did not ask the jury to find that any money wen. into toe defendant's pocket, and lie ventured to say there Was ne proof whatever that it did. If they found a general verdict of guilty the defendant could only be punished for one offence, or they could find him guilty on all or any of the counts or the vouchers. Judge Daniels commenced to charge the jury at 4:30 p. m. He paid the defendant was substantially charged with wilful neglect of duty, aud being a law yer and a man of culture and ability, he should be hey to a strict performance of the duty imposed upon him bylaw If a publio officer wilfully neglects to perform the duty imposed upou him by law he is guilty of a misdemeanor. The duty imposed upon the Board of Audit was cf a personal and judicial character, which required investigation, ihey naa no right to delegate that duty to anyone else. It was beyond doubt a personal duty required of the members of the Board. Did the defendant decline to perform that duty, if he did designedly and purposely, he committed a misdemeanor, for It is not necessary that there should be any design to defraud; it is enough if a party design- to perform an act which creates a crime. An inspection of the many bills pre sented, would have revealed frauds of a gross character; toe judge instanced one bill from wuicn was omitted tne creditor's name. The publio had the right to expect an examination of all of these bills. . AND HOTEL. Opposite U. P. R. R. Depot OCDEN CITY, E.UTAH. " LANDT, Prop. Single meals, 60 cts. Hoard fier week, $3.00.
