Show A VETO the charter is not amended the following is ho message of the governor to the house vetoing the proposed amendment to the charter of ogden city OF UTAH OFFICE SALT CITY march J hon Y W kiter speaker of the house of SIR I 1 heie with II 11 F no 63 without my approval it is entitled an act amending an act to incorporate ogden city this bill proposes to deal with a class of offenses which should be provided for by general statute applicable to the entire community it lias been a crying evil in this territory that the legislature has fo to exercise its lawful authority on needed subjects of legislation and has undertaken in many instances to confer power on local municipal ors to deal with the same subject acts regulating the conduct of the sexes toward one another are of vital importance in ayery territory state and nation they are peculiar to no district territory or clime they aar feet the welfare the social happiness the reputation of every community in the civilized world alie character of any community for order elevation and decency may be by the laws that exist in it for the suppression of vice tho protection of chastity the preservation of jhb morals and purity of its social condition weighed in this standard the social condition in utah is not such as gives her a very aerated place this bill is ono evidence that legislation is needed but an authority to permit the city to do what the territory of utah ought to do even if it were ever BO well conferred would be only an ac of the duty without performing it if buch practices mayba punished in the restricted limits should be equally offensive on the sand ridge adjoining and the thousands of square miles constitute the territory if a law on a general subject is good give the territory tho benefit of it if bad it should not affect even one little locality this proposed bill docs not go far enough in dealing with the afi anses it proposes to allow the city of ogden to punish it leaves the crimes of incest seduction bastardy adultery enticing and allowing amen to bo victims of unlawful sexual intercourse or to visit houses or rooms of prostitution and other like offenses untouched without ans prohibition creates lna crude and indefinite way I 1 am opposed to leaving to city in corporations only the power to deal with offenses offen see of this class they arc not petty trifling offenses but are vital crimea affecting the very constitution of society aliey should be dealt with in a way to strike at all evils of the kind and enable the social estate ia attacked by them to defend itself fully and thoroughly not by ordinances enforced through petty municipal courts but by the strong mailed baud of the courts of general jurisdiction while lust cau blicht the whole territory without finding any rebuke at tho hands of the legislature the attempt to confer power on a municipal corporation to punish local transgressions gres against morality in the indefinite inadequate and inoperative way done in thi bill cannot have my sanction I 1 am very respectfully eu H MURRAY governor |
