In Silver Springs. call v 7 ii i ii. y A TRA DITION IM Vickie Singer wins court battle, ownership of Marion farm Vickie Singer won her court battle last week over the ownership of the 21-acre Marion farm she and her family have occupied since 1957. In a four-page ruling following a four-day, nonjury non-jury trial in Ogden, Second District Court Judge Ronald Hyde declared that an agreement between John Singer and his uncle Gustav Weller existed, and that Mrs. Singer and her children could not be evicted. The eviction case was filed last year by Marion Park Estates, which is owned, in part, by the sons of Gustav Weller. Marion Park Estates claimed it owned title to the disputed land, and that Mrs. Singer should be evicted since she refused to pay rent. Mrs. Singer contended, however, that the 2-acre plot was given to her late husband as a gift from his uncle in exchange for 17 years of service on the 160- $1 8,500 total price for four week ownership ( $16,000 if cash). $4,625 down payment. 1 V2 interest over five years. Judge Hyde's ruling pointed poin-ted out that Singer moved to his uncle's farm in 1951 and that in addition to working on it, he also participated in a television repair business. In 1957, Singer moved to the contested land and built a log home, married Vickie and raised their seven children. Other improvements were made, said Judge Hyde, including in-cluding the building of a second home, a root cellar and smokehouse, clearing the land for crops, and building a schoolhouse. The judge noted that Singer paid property taxes on the land. When Singer and his uncle had "a parting of ways" in 1968, an oral agreement transferred title to the property to Singer.
