Accordingly Mr. Ostler was taken to Provo, but on arriving there he found Commissioner Hill away from home. Finally he was taken before Justice of the Peace, Brown, where he waived examination and was placed under bonds of $ 1,500. Mr. Ostler is about his business as usual. Mac., yesterday morning placed Chas. House under arrest charging him with unlawful cohabitation. In last Sundays S, L. Herald appears a piece written by T. O. (Thos; Osborne) relating to base ball in Nephi. The typo of the Herald who set it up did "our boys," unintentinoally.an injustice by not setting up the word "not when Mr. Osborne wrote it that way. The Herald has it: The Nephis invite every club in Southern Utah Fairview and Mt. Pleasant barred to come here and play. Morris by the owners of the San Pete Valley railway, from the positions of manager and secretary respectively of the road.it has been known that complications have arisen which the courts only could settle. The outcome is that these gentlemen were beforS U. S' Commissioner Norrell, in Salt Lake City last week charged with embezzlement perferred by Theodore Burback, present almanager of the S. P. V. railway. It is holds certain . that Bamberger leged moneys that rightfully belong to the company. The amounts embezzled are said to be $965.62 in April, 1SS5, and $273.25 in January, 18S7. There being at the close of the evidence for the prosecution a motion to discharge the defendants owing to a lack ot evidence, counsel on both sides entered into a prolonged discussion, which occupied the whole of Monday last. The commissioner, in summing up, said there was one important point: one agent could not be held responsible lor Ihe acts of another agent, except by col lusion. The only moneys, therefore, that Bamberger and Morris could be held responsible for were those directly traceable to them. He did not believe that any other than a lawful use had been made of the ducats traceable to their hands, and with such a view of the case he would discharge the defendants. They are still held, however, to an swer to another charge that of embezzling a trifling sum of postoffice moneys entrusted to their care. Mr. Dickson insisted that the case be heard at once.
