one two three and lour of the drinking water source protection area identified and descnbed as follows (a) Zone one is the area within a 100 loot radius from the wellhead or ings forms of extremely hazardous substances septic tanks dram fields class V underground injection wens landfills open dumps land filling of sludge and septage manure piles salt piles pit and animal feeding operations with more than ten animal units The following o pollution source clanfy the definition Uqmd Title III" (EPA 011) means any facility or site which employs an activity or procedure which may potentially contaminate ground water A source is a'so a potential conpollution tamination source (e) Regulatory agency means any governmental agency with jurisdiction over hazardous waste as defined herein means a disposal (f) Sanitary landfill site where solid waste including wastes or hazardous wastes are disposed ot on land by placing earth cover thereon means a system wb'ch is composed of a which acseptic tank and a cepts domestic wastewater from budd spring Zone two is the area within a (b) 250 day ground water time ot travel to the wellhead or spring the boundary of the aquiter(s) which supplies water to r water source or the the grounddivide whichever is closer Zone three (waiver criteria zone) (c) is the area within a time ot travel to the wellhead or spring or margin ol the collection area the boundary of the aquiter(s) which supplies wasource or the ter to the ground water divide whichever is closer (d) Zone four is the area within a time ol travel to the wellhead or spring the boundary of the aquifer(s) which supplies water to the water source or the grounddivide whichever is closer Section 4 Permitted uses The following uses shall be permitted within drinking water source protection zones Any use permitted within existing (a) agncultural single tamily residential residential and commercial distncts so long as uses conform to the rules and regulations of the regulatory agencies (b) Any other open land use where any building located on the property is cidental and accessory to the primary open land use Section 5 Prohibited uses The following uses or conditions shall be and are hereby prohibited within drinking water sources protection zones wnether or not such use or condition may otherwise be included as pad of a use perordmanly mitted under Section 4 ot tne ordinance Zone one The location of any (a) pollution source as defined herein Zone two - The location ot a pol(b) lution source unless its contaminated dis charges can be controlled with design standards Zones three end four The (c) location of a potential contamination source unless it can be controllnd through land management strategies Section 6 Administration Enforcement The poloes and procedures for administration and enforcement of any source zone established pursuant to protection tr is ordinance shal be the responsibly ot the owner of the and obligation pubic water system classified under this ordinance During the process of appScabon for classification and protection under this ordinance the owner of such public water system shall agree to indemnify and hold Millard
