Hildale UT wasanested at MP 162 by Utah Highway Patrol Trooper Mike Thomas Steed was driving a white 1995 Nissan pickup when he was stopped for an expired registration A record checked showed that his driver’s license was suspended for a traffic warrant out of Arizona He was transported to jail and charged into East Millard Justice Court with Class C misd driving on suspension and having an expired vehicle registration Bail was set at S340 which he posted and was released 9:00 pm Tiffany Edwards Clasen 20 Hinckley was in Hinckley by Deputies Morris Burton and Steve Allred Clasen was creating a disturbance at the residence and appeared to be intoxicated She refused to leave the premises and was taken into custody after a brief scuffle with the officers She was transported to jail and charged into West Millard Justice Court with Class B misd criminal trespassing and underage consumption of alcohol Her bail was set $500 which she posted and was released Friday January 26th 12:25 am Salvador Garcia 41 Fillmore was arrested in Fillmore by Deputies Rick Carter and Bill Jackson Garcia was driving a tan and brown 1992 Ford pickup when he was stopped for a number of traffic violations Carter stopped the vehicle for the violations and as soon as it came to a stop two subject exited the vehicle and would not take their hands out of their pockets as they approached Carter He conducted pat searches of both subjects and eventually had Garcia perform field sobriety tests prior to arrest Two open containers of beer were also found inside the vehicle Garcia was transported to jail and processed for DUI during which he tested at a blood alcohol level more than three times the legal limit which is 08 in Utah He was charged into Fillmore City Justice Court with Class B misd DUI alcohol He later appeared before Judge Ron Hare and was released on his own recognizance 6:15 pm Julian Soto 26 and Nickolas F Vitale 18 both of Costa Mesa CA were arrested on by Trooper Mike Thomas Vitale was driving a black 1993 Ford probe when he was stopped for speeding 85 mph in a 75 zone Upon contact with the occuHe administered pants of the vehicle Thomas could smell burnt marijuana inside the car field sobriety tests to Vitale and anested him for DUI A vehicle search uncovered marijuana inside the vehicle and Soto was arrested as well Both men were transported to jail Vitale was charged into EMJC with Class B misd possession of marijuana Class C misd DUI diugs speeding and excessive window tinting Bail on Vitale was set at $1385 and he remains in jail Soto was charged with Class B misd possession of marijuana and remains in jail pending a $555 bond East Millard Justice Court by Knox Huntsman Matters before Judge Ronald Hare January 23 28C1 at 10:00 am Order to Show Cause - City vs Jario A Briceno Briceno was order to show cause why he should not be sent to jail for 6 months Briceno is currently on probation for 12 months and one condition of the probation is no alcohol Briceno was caught with alcohol in his blood Briceno told the judge that he was attending alcohol abuse classes he faithfully reports to his probation officer and he is working full time in Nephi City Prosecution Attorney Richard Waddingham told Judge Hare that he was agreeable to give Briceno another chance Briceno was slow to respond to Judge Hare when asked how many more days in jail would be necessary to keep him from drinking Judge Hare decided that 2 more days would probably do it He must do the 2 days within the next 30 days A new probation for 12 months was ordered and will start immediately January 23 2001 at 2:00 pm Arraignment - Utah vs Daniel Jason Coleman Coleman was charged with Speeding and Driving on a Suspension (License) He posted bail of $380 He failed to The two were in a green 1992 Honda Civic when theywere stopped for speeding 89 mph in a 75 zone Masner could see and smell alcohol inside the vehicle when he spoke to die occupants Both were arrested like a giant maze at first glance Familiarization with the law and the system helps put it in a better perspective Millard County falls within the Utah State 4 District Court The judges that adjudicate the 4 District Court are assigned to MC out of Provo These judges normally have a tour of duty of 6 months Normal court is held every other Thursday at 10:00 am When a trial is required a different Provo trial judge is randomly assigned to a case and the judge schedules the case to be compatible with his calendar This court handles all felony and Misdemeanor A cases These cases are prosecuted by our local prosecuting In addition 4 attorneys Dexter Anderson and Brent Berkley with a staff of three District Court also handles the small claims cases The East Millard Justice Court (EMJC) works in conjunction with the 4 DC Judge Ronald Hare presides over the EMJC and he performs the majority of the arraignments for both courts Judge Hare says he adjudicates primarily the misdemeanor B and C cases The more senous offenders are sent on to 4 DC He adjudicates for both Millard County and Fillmore City He has a staff of three Hare says he was initially appointed as a Judge by the County Commissioners for four years and faces a Retention Election Hare is appointed as a Judge for Fillmore City by the City Council for four years Attorney’s Dexter Anderson and Brent Berkley also prosecute for this court if the offense occurs within MC however Richard Waddingham prosecutes for Fillmore City if the offense is within city limits Attorney James Slavens provides public defense for indigent defendants for both MC and Fillmore City if a Conflict Council arises Attorney Bryan Sidwell of Delta provides the public defense EMJC normally provides arraignments or Tuesday of action and advising the county commissioners on legal issues West Millard Justice Court in Delta is adjudicated by Judge Deb David She holds court on Tuesday at 1000 am Judge Stanley K Robison adjudicates offenses that are committed in the Delta City limits He holds court on Wednesdays at 9:00 am Richard Waddingham prosecutes for both Fillmore (Tuesday) and Delta (Wednesday) Brent Berkley normally prosecutes for MC in Delta (Tuesday) and Fillmore (Wednesday) Judge David was appointed by the MC Commissioners and faces a Retention Election every four years Judge Robinson was appointed by the Delta City Council The Sheriff’s Office in Delta has a small holding cell to briefly hold a prisoner before being transported to the Jad in Fillmore Attorney Lawrence H Hunt provides public defense for indigent defendants in Delta The Sheriff’s Office has the capability of televising a defendant'prisoner within the MC Jail in Fillmore and holding a trial for the defendant in Delta This saves the expense of transporting the prisoner Years ago the Utah State Legislature adopted a policy that people who commit crimes should pay restitution depending on the offense They adopted a surcharge to be tacked on to some fines Basically there is not a surcharge on nonmoving violations: while moving violations and criminal violations have a surcharge Fines that are given in East and West Millard County are retained by the county (if the offense occurs in the county) and to Fillmore City or Delta (if the offense occurs in the city) The Utah State takes The state distributes the 35 of the surcharge and either the county or city retains 65 35 to about 5 different agencies (Victims Crime Reparations Fund being one of them) There are always exceptions: If the offenses were either Over Weight Parks and Recreation or Wild Life related then the state takes all of the fine which is distributed to the District fines go to the state unless the crime was committed appropriate agency within the city then the city gets 50 Judge Hare's Court in 2000 handled over 0000 cases with about 90 of them being traffic MC collected $486000 from the fines and Fillmore City collected $4 000 This
