CITY CER- GUIDELINES AND STANDARDS TO THE ANNEXATION SAID TERRITORY CONDITIONS RECITALS The Ciy Council of the Crty of Delta Utah (referred to hereto as the "City Courecites the following as the basis tor adopting the following ordinance: A In 1981 Delta City annexed certain territory into its corporate limits pursuant to Ordinance No B The annexation was based on Delta City's determination that housing development and additional facilities were needed to accommodate the anticipated population increase due to construction and operation of the Intermountain Power Project in the vicinity of Delta Utah C The petitioners lor such annexation purposed a planned unit development which would encompass all of the property being considered for annexation D At the time of said annexation Delta City had a policy requiring foat a portion of such annexed territory be dedicated for parks and recreation Furthermore the annexation petitioners were required to obtain a sufficient amount of water rights (367 acre feet) to meet the needs of the proposed planned unit development E In 1982 the Delta City Council (amended by passed Resolution No Resolution No providing for water connection fees including a water rights acquisition and development fee as a oorv dition to receiving culinary water service from Delta City in the annexed territory F In 1983 the Policy Declaration Statement for Annexation was amended to remove the park and recreation dedication requirements by Resolution No 83 86 G The planned unit development contemplated by Ordinance No 81 28 was not constructed The annexation petitioner's successors in interest are now currently developing the property for single home residences The current owners are not in need of the amount of water requested unnor should they der Ordinance No be subject to the park and recreation dedication requirements of said Ordinance The current owners should now be subject to the connection tees and water rights acquisition and development fees required 0 and any sucunder Resolution No cessor ordinance or resolution amending 10 Resolution No NOW THEREFORE BE IT ORDAINED by the City Council of the City of Delta Utah: City a title report from a title company currently licensed to do business in the State ot Utah the petitioners to be the showing owners of the property annexed free of any liens or encumbrances
