Show RESOLUTION. Proposing an Amendment to Section 3, Article XI, of the Constitution Relating to Counties, Cities and Towns. For the Purpose of Prescribing Prescrib-ing Manner of Creating New Counties And Chang-ing Chang-ing Boundaries. Be it Resolved and Enacted by tho Legislature of the State of Utah, Two-Thirds of the Members Mem-bers Thereof Concurring Therein : Section 1. That the following proposition to amend the Constitution Consti-tution of tho State of Utah is hereby submitted to the qualified electors of the State for their approval ap-proval or disapproval, namely: Thnt Section 4, Article 13 of the Constitution of Utah be, and the same is hereby, nmended to rend ns follows: Section 4. All mines and mining min-ing claims, both placer and rock in place, containing or bearing Gold, Silver, Copper, Lead, Coal or other Valuable mineral deposits, depos-its, nfter purchn.se thereof from the United Stntes, shall be taxed at the price paid the United States therefor, unless the surface sur-face ground, or some pnrt thereof, there-of, of such mine o"r claim, is used for other than mining purposes, and has a separate and independent independ-ent value for such other purposes; purpos-es; in which case said surface ground, or any pnrt thereof, so used for other than mining purposes, pur-poses, shnll be taxed nt its value for such other purposes ns provided by law: and all the machinery used ' in mining, and nil property and surface improvements im-provements upon or appurtenant to mines and mining claims, which have u valuo separate and independent of nil such mines or mining claims, and the net annual proceeds of all mines nnd mining claims, shall be taxed by the State Board of Equalization. Section 2. The Secretary of State is hereby ordered to give this proposition to be published in at least one newspaper in every ev-ery County of the State where a newspaper is printed and published publish-ed for two months preceding the next general election. Section 3. The following proposition, to amend the Constitution Consti-tution of the State of Utah is hereby submitted to the qualified electors of the State for their approval ap-proval or disapproval, namely: That Section 3, of Article XI of the Constitution of the State of Utah be, and the same is hereby amended to read asfollows : "Section 3. The Legislature shall have power to enact laws creating new counties out of territory ter-ritory tnken from one or more of the existing counties of this Stnte, nnd defining the duties nnd obligations of any such new county, coun-ty, ns between itself - and any county from wliich territory is taken in its creation." Also to ennct lnws changing the boundaries boundar-ies of any county. Section 2. Be it Resolved and Ennctcd by the Legislnture of the State of Utah: Section 1. That it is proposed lo amend Section 7 of Article XIII of the Constitution of the State of Utah so that the same will read as follows: 7. The rate of State taxtion on property for State purposes purpos-es shall never exceed eight mills on each dollar of valuation; four and one half mills on each dollar of valuation for general state purposes; three mills on each dollar of vnluation for district school purposes ; one half mill on each dollar of valuation for high school purposes; and whenever tho taxable property within the State shall amount to Four Hundred Hun-dred Million Dollars, tho rate shall never thereafter excewl five mills on each dollnr of valuation ; unless n proposition to increase such rate, specifying the rate proposed pro-posed and the time during which the same shall be levied, be first submitted to n vote of such qualified quali-fied electors ns shall have paid a property tax assessed to them within the State in the year next preceding such election nnd the majority of those voting thereon shnll vote in fnvor thereof in such mnuner ns iwiy be provided by law. Section 2. The Secretary of Stnte is directed to submit this proposed amendment to the electors elec-tors of the State at the next gen-ral gen-ral election, in the manner provided pro-vided by law.
