Show Notice Is hereby given to the people of Logan City that all ditches in front of their city lots must be cleaned out immediately and also kept in good repair throughout the season, to prevent water from flooding the streets or sidewalks. Old foot bridges must be repaired and kept in good order throughout the season and new bridges put in when lacking. Please read the ordinance in relation to water, &c (etc.). N. Hansen, Watermaster. An Ordinance in relation to Sidewalks and Water Ditches. Sec. (Section) 1. Be it ordained by the City Council of Logan City that all owners or occupants of lots in said city are hereby authorized and required to dig suitable ditches to convey the waters running in the streets along the fronts and sides of said lots, to the acceptance of the City Watermaster. Sec. (Section) 2. Said ditches shall be made sixteen feet from the fence line of city lots on Main Street, and twelve feet from the fence line in all other streets, except such streets as are only four rod wide, in which said water ditches shall be ten feet from the fence line. Sec. (Section) 3. Where it is necessary to convey water across a sidewalk for purposes of irrigation, said channel shall be bridged properly so that the sidewalk shall not be damaged. Sec. (Section) 4. All owners or occupants of city lots are hereby required to make and keep in repair and condition for travel, the sidewalk adjacent to their respective lots; and if a corner lot, are also required to make and keep in repair a bridge across the water ditch at the corner of said lot, not less than four feet wide, at the corner of each block. Sec. (Section) 5. The City Watermaster is hereby required to see that owners or occupiers of city lots conform to the provisions of this ordinance, and notify them of any neglect or breach of the same, and it is hereby made his duty, ten days after such notice has been given, and said neglect or breach has not been rectified, to cause such necessary improvements to be made at the expense of said owner or occupier of the lot; who shall also be liable to a fine not exceeding twenty-five dollars for each offense; which expense and fine may be collected by suit before the Mayor or Alderman. Sec. (Section) 6. If any person or persons build a bridge over a ditch crossing a sidewalk, or between the sidewalk and street, and any such bridge for want of proper repairs, damages any sidewalk or street, or prevents the free travel of any foot passenger or team of any kind, or causes any damage to any other property, such person or persons failing to make such repairs after sufficient notice has been given, shall be liable for all damages that may arise in consequences thereof. Sec. (Section) 7. Any person or persons holding any grant of water privilege for machinery, irrigation or other purposes, who shall suffer any damage to any street, sidewalk, ditch or bridge as herein specified in the preceding sections of this ordinance, or cause any lot to be flooded with water; or any damage to any building or any other property; and upon evidence being adduced that such damage was caused by failure on the part of the person or persons holding said grant of water privilege, such person or persons shall be liable to forfeit their said grant, and to the penalties specified in this ordinance. Sec. (Section) 8. All owners or occupiers of farming land within the limits of this city, are hereby required to make their proportion of good and sufficient water ditches for irrigation, and keep the same in repair, under the direction of the Watermaster, who shall be required to give reasonable notice of the time and place such work is to be done. Sec. (Section) 9. All persons are forbidden to run water or dig ditches across the public streets or roads within the limits of this corporation, for the purpose of conveying water for irrigation or other purposes, unless they stone, gravel or culvert the same under the direction of the Supervisor. Sec. (Section) 10. Any person or persons neglecting or refusing to comply with the provisions of this ordinance, shall be liable for all damages arising therefrom, and to a fine not exceeding one hundred dollars for each offense, or imprisonment not exceeding six months.
