(There are other necessary street improvements, such as asphalt street paving, miscellaneous piping, et c, which are required to complete the project; however, the cost of said other improvements are to be paid with other City funds.) Optional Improvements: The are those improvements which are to be installed, as detei mined by the City, and shall be completed if the District is formed. The District may, if instructed by install owners, property optional improvements, such as concrete or asphalt driveways and assess such improvements to each individual property owner. Estimated cost of improvements of cost The total improvements (curb, gutter and sidewalk) in the proposed District, as estimated the City Engineer, is $115,920, to be paid by a special tax to be levied against the property abutting upon the streets to be improved or upon property which may be affected or specifically benefitted by such improvements. Assessment and levy of taxes It is the intention of the Council of the City to levy assessments as provided by the laws of the State of Utah on all parcels and lots of real property within the District benefitted by said improvements. The purpose of the assessment and levy is to pay those costs of the subject improvements which the City will not assume and pay. The method of assessment shall be apportioned to the front according footage of lots and parcels of property within the District, unless otherwise specified. A fifty (50) foot reduction in frontage will be allowed on corner lots where street pavement is constructed on both sides of corner lots; a forty (40) foot reduction in frontage will be allowed on corner lots where sidewalks and-'ocurb and gutter are constructed on both sides of corner lots. Land and lots which abut the streets identified above, or which are adjacent thereto, shall be assessed to a depth of twelve (12) rods back from the property line of the streets or streets upon which they abut or to which they are adjacent (one lot only in subdivided areas). The costs of the improvements as they pertain to the streets included in the various improvement categories shall be and to the abutting or assessed by adjacent lots and land on a basis, except where otherwise not ed. The assessments may be paid by property owners m ten (10) annual installments, with interest on the unpaid balance at a rate or rates fixed by the Council, or the whole or any part of the assessment may be paid without interest within fifteen (15) days after the ordinance levying the assessment becomes effective. The assessments shall be levied according to the benefits to be derived by each property within the District. Other and payment provisions enforcement remedies shall be in accordance with Chapter 3. of Title 17A, of Annotated Code Utah (1953), as amended. A map of the proposed District, copies of plans, profiles and specifications of the proposed improvements and other related information are on file in the office of the City Recorder, who will make such information available to all interested persons. Time for filing protests Any person who is the owner of record of property to be assessed in the District described above in this Notice of Intention shall have the right to file in writing a protest against the creation of the District or to make any other objections relating thereto.
