The play was not so well attended tho second night. The case of Bina Nelson vs . U. P. Ry. Co. came up beforo Jndge Willis on Friday. This case grow out of the killing of a cow belonging to Mrs. Nelson Nel-son last July. It would appoar that tho cow was just crossing tho defendant' track near the sugar fac;ory switch on tho State road when the north bound train caught it 'and threw it down tho embankment resulting in the cow's death. The plaintiff sued for $40.00 damagee. Tho defendant seemed to have taken no precaution to avoid the accident, so a verdict of $35.00 was rendered in favor of plaintiff. Tho Ry. Co. will probably make a test case of this suit and carry it up to tho higher courts. Evans and Thurinan represented Mrs. Nelson and Attorney Savory, o finlt Lake, defended the Rv. Co. |
