Show OU Lakeside RGVteW passes only a portion of suggested changes Kaysville By RUfef MALAN Standard Examiner correspondent KAYSVILLE - The city council o pass an amendment to the revised ordinances of the city during a Recent council meeting, but instead tabled part of it and passed only a small portion of the suggested changes. the amendment had passed in its entirety, it would have brought some major changes by eliminating the rural home occupation portion of the As it is, the council just passed the portion of the ordinance dealing with residential child care as required by the state and a couple of other minor changes. The child care portion is now a separate part of the ordinance and is defined as the continuous care and supervision 'of five or more children under 14 years W lage for less than 24 hours a day. The state requires that day care homes have at-t- ordi-ri'anc- e. tl j Saturday June 13 1998 an outdoor play area and the city ordinance didn't allow that. One change that goes into effect immediately is that those with major home occupations must notify property owners within 300 feet of the property where the home occupation is. Larry Huston of the planning commission told the council that Kaysville is fortunate to have a reputation for being tough on high traffic and has kept its community style standards. But with home occupations in rural areas, those standards seem to be threatened, Huston said. The biggest concern is the heavy industrial usage with heavy equipment going in and out of residential areas on a daily basis, he said. We are doing it wrong. We should set apart land for business zoning which limits the size and scope of business equipment at someone's home. He said home businesses should be incidental to the home and not the home incidental to the business. Brent Mitchell told the council that he has lived in Kaysville for 45 years and has always operated his business from his home. He has four trucks that wouldnt meet the new amendment and would be forced to move from town. He asked that the amendment not be passed. And Belinda Pierce agreed with him. I live in an agricultural area and I have four trucks. I have a special use permit to park them on my property, Pierce said. Her dump trucks are used on the reconstruction project and are dispatched out of Salt Lake City. They are parked on her property during the winter. Dean Kynaston has a decorative curbing business and uses a large truck that is parked in his driveway when not in use. I don't run around Kaysville streets unless I am serving a Kaysville resident, Kynaston said. This all came to a head because of another curbing contractor who moved from Galley Subdivision to west Kaysville, and apparently the residents don't like him parking on the streets. I can't see how that truck influences anybody's living conditions when it is parked in my yard. I feel this new ordinance would be unjustified to some people, he added. City engineer Andy Thompson said that the ordinance would not be retroactive. Those with existing businesses would not be affected unless they modified their business m any way. Blair Scoresby said he lives in a neighborhood with an excavation contractor and he thinks it is an asset to the neighborhood. Jumping too quickly would be a mis take, Scoresby said. Another member of the planning commission, Dave Faerber, said the planning commission looked at revising the ordinance because some of the uke$ under home occupation didn't fit. Ahd the ordinance doesn't allow or disallow employee parking. I feel we needed clarification then?.? he said. And James Smith, who has lived"in Kaysville 65 years, said the ordinance doesn't take into account the amount of space on the lot. You have to consider a lot of factor not on the surface," Smith said.
