GARFIELD COUNTY ORDINANCE 2011-1 AN ORDINANCE RE-AUTHORIZING ORDINANCE 2000-1, CONTINUING TO FUND RURAL COUNTY HEALTH CARE FACILITIES IN GARFIELD COUNTY, STATE OF UTAH WHEREAS, the Board of County Commissioners of the County of Garfield, State of Utah has the responsibility to determine county policies within the County of Garfield; and WHEREAS, in February of 2000, Ordinance 2000-1 was authorized by Garfield County Commissioners, effectively adopting and imposing a local sales and use tax of 1% to fund health care facilities. WHEREAS, the County Commissioners of Garfield County, State of Utah, believe it to be in the interestes of the health, welfare and safety of its citizens to re-authorize Ordinance 2000-1. NOW THEREFORE, be it resolved by the Board of Commissioners of the County of Garfield, State of Utah as follows: 1. Garfield County Ordinance 2000-1 is re-authorized under the same conditions and terms previously adopted. 2. This tax shall be levied for a period of ten years and may be re-authorized at the end of the ten-year period by the county legislative body as provided in Section (1) of Ordinance 2000-1. Answer by: Carolyn Washburn, Utah State University Extension If you are looking for new ideas to stretch the home budget, consider making home cleaning products. Homemade cleaning products are less toxic, safe, effective and cost less than cleaning products from the store. Basic supplies for making your own cleaning products include baking soda, vinegar, lemon juice, borax, cornstarch and salt. Consider these uses. • Baking soda neutralizes acid-based odors in water and adsorbs odors from the air. Sprinkled on a damp sponge or cloth, baking soda can be used as a gentle, non-abrasive cleanser for kitchen counter tops, sinks, bathtubs, ovens and fiberglass. For laundry, add up to a cup per load to eliminate perspiration odors and neutralize the smell of chemicals. It is also a useful air freshener and carpet deodorizer. • White vinegar and lemon juice are acidic and neutralize alkaline substances such as scale from hard water. They are natural cleaning products as well as disinfectants and deodorizers. Acids dissolve gummy buildup, eat away tarnish and remove dirt from wood surfaces. Vinegar can be used as a softener in laundry cleaning. Lemon juice can be mixed with vinegar and baking soda to make a cleaning paste. • Borax is a natural cleaner and bleach. It can boost other cleaning products, but be cautious when using it since it can cause skin, eye and respiratory irritation. Don't use borax around food, keep it out of the reach of children and pets and be sure to rinse it out of clothes and off surfaces. • Cornstarch can be used to clean windows, polish furniture and clean carpets. As a window cleaner, use it with water, vinegar and ammonia. There are many reasons couples chose to live together rather than marry, including reducing living expenses, or not wanting to give up certain assets (i.e., social security or other retirement benefits) that may be lost if a person remarries. However, unless you define your partnership through a written legal contract known as a Cohabitation Agreement, you may be taking a great risk. Although you may regard your partner as a family member, the law may not. As a result, your partner may not be taken care of in the manner in which you wish, or inherit your estate should you pass away. Paradoxically, the law may provide certain benefits for your partner that you had no intention of giving to him or her. The courts have precedent to use equitable doctrines to apportion assets between cohabitants to prevent hardship and injustice. It is far better to be proactive and to define your own partnership through a Cohabitation Agreement, a private contract between cohabitants. It is a powerful tool for disclosing the financial and personal expectations of the relationship. It can prevent misunderstandings and legal battles. It contractually establishes the rights and obligations of the parties. The attorney drafting the Cohabitation Agreement will outline the parties' wishes regarding property and the possible sharing of any assets, as well as the terms of the relationship. It can cover any financial aspect of the relationship, including, but not limited to, the distribution of property in case of death or breakup, obligation for (or elimination of) financial support during the relationship or upon its dissolution, the responsibility of each party for specific debts, ownership of the principal residence upon breakup of the relationship, definition of support, custody or visitation rights for minor children, specification of health insurance coverage, determination of the right to serve as guardian/ conservator in the event of incapacitation, and establishment of the right to make medical decisions. Each partner should have individual legal advice, and the contract ideally should be drawn up prior to living together. It is important to note that there is a difference between Cohabitation Agreements and Prenuptial Agreements. Cohabitation Agreements are governed almost exclusively by general contract principles. They usually are no longer valid if the parties eventually many. A Prenuptial Agreement goes into effect only upon marriage and is binding throughout the marriage unless both parties agree to modify it. From the viewpoint of Estate Planning, a Cohabitation Agreement can eliminate concerns that your cohabitating partner may, against your desires, attempt to access your assets upon dissolution of the relationship or upon your death. Your rights and obligations would have already been set forth in your Cohabitation Agreement. Conversely, a Cohabitation Agreement can help ensure that your assets will go only to your choice of beneficiaries, which may include your cohabitating partner if you so wish. Jeffery J.
