Regulating Licenses AN ORDINANCE REGULATING AND LICENSING CERTAIN CLASSES OF BUSINESS IN EMERY COUNTY COUN-TY OUTSIDE INCORPORATED CITIES AND TOWNS, AND REPEALING RE-PEALING ORDINANCE NO. 2, AND ORDINANCE NO. 9, OF THE ORDINANCES OF THE COUNTY OF EMERY, STATE OF UTAH, AND REPEALING ALL ORDINANCES ORDI-NANCES IN CONFLICT HEREWITH. HERE-WITH. The Board of County Commissioners of Emery County to ordain as follows. fol-lows. Section 1. That Ordinance No. 2 and Ordinance Ordi-nance No. 9, of the ordinances of Emery Em-ery County, State of Utah, and all ordinances or-dinances in conflict herewith, be and the same are hereby repealed. . Section 2. That It shall be unlawful for any person to engage in any business hereinafter here-inafter specified, within Emery County, Coun-ty, outside the limits of incorporated cities and towns, without first obtaining obtain-ing a license therefor as provided in this ordinance. Section 3. All applications for license under this ordinance shall be made in writing writ-ing to the County Clerk, and the a-mount a-mount as hereinafter provided shall be paid in advance into the County Treasurer and all licenses issued shall be signed by the County Clerk and sealed by the corporate seal of the County of Emery; the clerk shall keep a record of all licenses issued and the amount paid therefor. Section 4. Licenses shall be issued at the following fol-lowing rates and on the following terms: Merchants, Wholesalers, and Retailers. Retail-ers. Every merchant, wholesaler, or retailer, before commencing or carrying carry-ing on a business, shall make a statement state-ment of the cash value of his goods, wares, and other merchandise, which he may have in his possession or under un-der his control whether owned by him or consigned to him for sale, which statement shall be sworn to before a Notary Public, by the merchant making mak-ing it or his duly authorized agent, which statement shall be filed with the County Clerk. The County Clerk shall file all such statements in alphabetical alpha-betical order, and shall, upon the Treasurer's receipt for the amount specified for the class the statement classifies the applicant In, issue either a quarterly or yearly license li-cense to the applicant. A quarter as specified in this ordinance shall be from January 1st, to up to and Including In-cluding March 31st; from April 1st, to up to and including June 30th; from July 1st, to up to. and including September Sep-tember 30th; from October 1st, to up to and including December 31st of each year. The classes as specified in this ordinance shall be as follows: Over $20,000 and not exceeding $40,-000, $40,-000, shall constitute the first class and pay $30.00 per quarter year. Over $12,000 and not exceeding $20,-000, $20,-000, shall constitute the second class and pay $25.00 per quarter year. Over $8,000 and not exceeding $12,000, shall constitute the third class and pay $18.00 per quarter year. Over $5,000 and not exceeding $8,000, shall constitute the fourth class and pay $16.00 per quarter year. Over $3,000 and not exceeding $5,000, shall constitute the fifth class and pay$12.50 per quarter year. Over $2,000 and not exceeding $3,000, shall constitute the sixth class and pay $10.00 per quarter year. Over $1,000 and not exceeding $2,000, shall constitute the seventh class and pay $8.00 per quarter year. Not exceeding $1,,000 per year, shall constitute the eighth class and pay $5.00 per quarter year. Section 5. Hotels. Whosoever shall keep a house with furnished rooms for the accomodation of travelers, and board the occupants of such rooms, shall be deemed a hotel keeper, and before engaging en-gaging In such business, shall pay a license of $12.50 per quarter year. Section 8. Restaurants. Whosoever shall keep a public place for furnishing meals without lodging, is declared to be a restaurant keeper, and shall pay a license li-cense of $10.00 per quarter year. Section 7. Peddlers. It shall be unlawful for any person to carry on the business of peddling or hawking, or to offer for sale, barter or exchange, at retail, any garden or farm produce, butter, eggs, poultry, fish, game, medicine or other goods, wares, or merchandise. No person, per-son, firm, or corporation as principal or agent, shall peddle out, hawkorcan-vass, hawkorcan-vass, by going from house to house and sell or offer for sale, by sample, to users or consumers clocks, agricultural agricul-tural implements, tools or machinery, stoves or ranges, wagons or buggies, carriages, surreys, or other similar vehicles, washing machines, churns, pictures, enlarged pictures or picture pic-ture frames, lightning rods, spectacles, jewelry, sewing machines, books or musical instruments, merchandise or medicine, within the county of Emery, outside the limits of incorporated cities and towns, wlchout first obain-lng obain-lng a license therefor, provided that nothing herein shall he deemed to op-ply op-ply to persons offering for sale fruit, butter, vegetables, eggs, fish poultry, and milk raised or produced by themselves. Sectlo.i 8. License Amount. License for carrying car-rying on the business of peddling or hawking as above described, may be Issued for one or more days, upon the payment in advance of $2.50, per day or for three months upon the payment pay-ment of $5.00, in advance. Provided that nothing In this section shall be construed to prohibit any regularly established merchant, operating under a license, from selling or otherwise disposing of any article herein mentioned, men-tioned, by filing the statement of valuation val-uation of such article as provided In Section (4) four of this ordinance. Section B. Miscellaneous Licenses. Every person, per-son, before engaging in or pursuing any business, vocation or calling hereinafter here-inafter mentioned, shall obtain a license therefor unless otherwise provided, pro-vided, and make payment totheCounty Treasurer in advance as follows: For a license for each public theater. $2.50. For a license for each public concert, and concerts given for charitable or benevolent purposes, shall not, In the discretion of the County Clerk, $2.50. 1'rovlded that public theaters be subject to the payment of a license. For a license for each exhibition or traveling shows, circuses, wild animals, ani-mals, or tricks of legerdemain, $2.50 For a license for each shooting gallery, gal-lery, per day $1.00. For a license for each shooting gallery, gal-lery, per month $5.00. For a license for each pool table, per quarter year $7.50. Section 10. Every person who shall engage in or attempt to carry on any business for which a license is provided, without first obtaining a license therefor, as in this ordinance provided, is guilty of an offense; and every person who violates any of the provisions or requirements re-quirements contained In this ordinance, ordin-ance, where the penalty Is not provided, pro-vided, shall upon conviction be punished pun-ished by a fine of not more thai $299.00, or by imprisonment in the County jail, not exceeding three months, or by both such fine and imprisonment. im-prisonment.
