Show DOD Issues Reminder to Employees On New Section Riot and Civil Disorder Law The Department of Detense has sent a reminder to civilian personnel regarding provisions of Public Law Section 7313 on riots and civil disorders. The new section became part of the law on June 19, 1968. A memorandum from W. J. Aliemethy director of personnel. Assistant Secretary of Defense (Administration), states that the law affects all government em- shall be removed from such sition. 90-13- ployees. THE MEMORANDUM, addressed to all civilian personnel" notes that significant requirements of the statute are contained in Section 7313. The section states that an individual convicted by any federal, state, or local court of competent jurisdiction of (1) inciting a riot or civil disorder; (2) ORGANIZING, promoting, encouraging, or participating in a riot or civil disorder; (3) aiding or alietting any person in committing any offense specified in clause (1) or (2); or (4) any offense determined by the head of the employing agency to have leen committed in furtherance of, or while participating in, a riot or civil disorder; shall, if the offense for which he is convicted is a felony, lie ineligible to accept or hold any position in the government of the United States or in the government of the District of Columbia for five years immediately following the date upon which his conviction becomes final. THE MEMORANDUM explains that for the purposes of Section 7313, means felony any offense for which imprisonment is authorized for a term exceeding one year. Provisions of the new section 7313 apply only to acts committed after the date of enactment, June 19, 1968, the memo states. The provisions apply to the acts of both federal employees and applicants for federal employment committed after the enactment date.
