witnesses for the defence were called their examination continuing until 1 about half balf past six when wilen the court adjourned until this morning at 10 on re resuming the investigation this morn morning ind InU mr hir john reading beading the last witness for the defence was called to the stand the burden of all the witnesses for the derence defence was that J TL orr when at the polls on election day w was as according to their best judgment m ent and belief under the influence of liquor as well as the tho U S machal and other deputies that orr by his noisy proceedings at the ballot bailot box hindered the business of voting and that during the obstruction st caused by orr the judge of the election called for police to clear the way for voters that orr was not then interfered with but abathe that thab ho was subsequently arrested for assaulting mr james white a special policeman who was engaged that day in keeping beeping clear the passage a e through h which voters passed after having deposited their ballots at the close of the examination for the de defence fenee the prosecution called several witnesses among them Dr Sprague and gov woodston Wood sto prove that orr and tho the U S marshal were not only sober on that day but that they were generally noted for sobriety and exemplary conduct at the close of the testimony the prosecution announced that they waived their right to make the opening speech und and that if the defence were willing they would submit tho the case without argument I 1 this however the defence dec declined linea to do 0 and mr snow opened for the the evidence and the provisions of the law under which the U B S marshal and ills his deputies claimed to act on election day mr sutherland followed and claimed that the accused had the right to be discharged on the grounds following thai that the united states marshals had no duties to perform at elections under the act of feb 28 1871 for the following reasons FIRST salt sait lake city is not shown to be a city of twenty thousand inhabitants SECOND S V 00 no supervisors to scrutinize the elections were appointed THIRD nto no deau deputy ty mar marshals were requested by two citizens FOURTH general deput deputies 1 es are not authorized to act at elections unless special deputies have been appointed he also contended that U S marshals are not of the peace except to prevent offen ces against the united states or to arrest for such of lences fences that the election held here on the 3rd ard of august was held under Terri territorial tOrtal laws was governed governed by territorial police that all elections even if a representative or delegate to congress Is to bo be elected are to be held under the local law unless the act of feb 28 1871 is made to apply by the preliminaries men tinned in section 2 and 8 of said act and that eyen even if the marshal and aud his deputies were authorized to exercise exorcize on the ard instant in this city the powers contemplated by the act of congress above referred to and were conservators conservatory conserva tors of the peace they have not i by virtue of this act and co conceding n ceding its applicability to this city the exclusive duty of enforcing the laws for its preservation but they were bound in the exercise of such police pollee power if they possessed it to act in concert with or at least not in
