Show I CONSTITUTIONAL AMENDMENT A JOINT RESOLUTION PROPOSING PROPOSING PROPOSING PRO PRO- POSING TO AMEND ARTICLE ARTICLE ARTICLE ARTI ARTI- CLE XIII SECTION 2 OF THE fHE CONSTITUTION 0 OF F T fH THE H E ESTATE ESTATE STATE OF UTAH RELATING TO TANGIBLE PROPERTIES EXEMPT FRO FROM t TAXATION Be De it resolved by the Legislature Legislature Legis Legis- lature of the State of Utah two thirds of all members elected elected elect elect- ed cd to each of the two houses voting in favor thereof Section 1 It is proposed to amend Article XIII Section 2 of the constitution of the State Slate of Utah to read as follows All tan tangible ible property in the state not exempt under the laws of ot the United States the thed State of Utah or un er this d constitution shall be taxed in proportion to its value to be ascertained as lS provided by law The property of the state counties counties courties coun cour ties cities towns school districts districts dis districts dis- dis municipal corporations and public libraries lots with the buildings thereon used exclusively ex ex- elus ely for either cither religious worship or 01 charitable purposes and places of burial not held or used for private or corporate benefit shall be exempt from taxation Water rights ditches canals reservoirs power plants pumping plants transmission owned lines pipes and flumes and used by individuals or corporations cor car for irrigating lands within the state owned med by such Individuals or corporations or orthe orthe orthe the individual members thereof shall not be separately taxed as long as the they shall be owned and used exclusively for such pur pur- poses Power plants power transmission lines and other property used for generating delivering delivering- electrical power a portion of which is used for furnishing power for pumping water for irrigation alion purposes on lands in the State of Utah may maybe maybe maybe be exempted from taxation to the extent that such property is is S d sd for or such purposes These exemptions shall accrue to the benefit of the users of or water so BO pumped under such regulations regula regula- regula- regula l Lions as s the legislature ma may prescribe The fhe la taxes cs of the indi indigent inch inch- emitted or be bs i gent l poor may l at such times and In such sanner i as may be provided by lay la laThe The legislature may provide pro- pro vide ide for the Hie exemption from taxation of homes homesteads and personal property not to exceed 20 2030 in value for homes and homesteads and all household furnishings furniture and equipment used exclusively by the owner thereof at his place of abode in in maintaining a home for himself and family Property not to exceed in value owned by disabled persons who served in any war warIn warin warm in m the military service ice of the UJ United ted S States Stales tes or of the St State te teof of Utah and by the unmarried widows and minor orphans of such disabled persons or of persons per sons who while serving in the military sen Ice of the United St States tes or the State of Utah were killed in action acHon or died as asa asa asa a result of such service Benice may maybe maybe maybe be exempted as the legislature may mav may provide The legislature shall provide by law for an m annual tax sufficient sufficient with other sources of or revenue to de defray ray the estimated ordinary expenses of the State for each fiscal y year r. r For the purpose of or paying the state debt if any there be the legislature legis lature shall provide for levying a tax annually sufficient to pay the annual interest and to pay the principal of or such debt wIthin within within with wIth- in twenty years cars from the final passage passage of the law creating the debt Section 2 The secretary of state is directed to submit this proposed amendment to the electors electors elec elec- tors of tho the State of Utah in the next general election in the manner provided by law Section 3 If adopted b by the cl electors of or this state this amendment shall take effect the first day of January 1961 I LAMONT F.
