WHEREAS, the City of Milford, Utah, owns several city parks, public areas and property or y on either or both sides of some or all streets located within the limits of the City of Milford, and WHEREAS, the City of Milford, Utah, is authorized by Section Utah Code Annotated to plant, or direct and regulate the planting of, ornamental shade trees in streets, parks and public grounds; and WHEREAS, the City of desires to obtain grants Utah Milford, for the beautification of streets, parks and public grounds and, in order to obtain grants, the City must have an ordinance creating and establishing a City Tree Board; and WHEREAS, diseased trees and trees causing a nuisance on private property can be a threat to other trees located on property owned by the City or other private landowners. NOW, THEREFORE BE IT ORDAINED by the City Council of the City of Milford, Utah that there be established an ordinance defined as follows: Section 1. Deflnhlona. STREET TREES: Street trees are herein defined as trees, shrubs, bushes and all other woody y vegetation on property or owned by the City of Milford, Utah, lying between property lines on either side of all streets, avenues, or alleyways within the City. PARK TREES: Park trees are herein defined as trees, shrubs, bushes and all other woody vegetation in parks and public areas owned by the City of Milford, Utah. rights-of-wa- 0, rights-of-wa- 2. and Creation Section Establishment of a Milford CHv TW Board, There is hereby created and established a Milford City Tree Board for the City of Milford, Utah, which shall consist of five members, citizens and residents of the City of Milford, Utah who shall be appointed by the Mayor w ith the approval of the City Council One member of the Board shall be a member of the City Council. Section 3. Term of Office of the Milford Citv Tree Board. The term of the five persons to be appointed by the Mayor shall be two years, except that the term of two of the members appointed to the first City Tree Board shall be for one year and the term of two of the members of the first City Tree Board shall be for one year and the term of two of the members of the first City Tree Board shall be for two years. The term of the member of the City Council shall coincide with their term of office. In the event that a vacancy shall occur during the term member, his successor shall be appointed for the unexpired portion of the term being vacated. Section 4. Such plan will be presented annually to the City Council and, upon their acceptance and approval shall constitute the Official Comprehensive City Tree Plan for the City of Milford, Utah. The City Tree Board, when requested by the City Council, shall consider, make findings, report investigate, and recommend upon any special matter or questions coming within the scope of its work. frrtVm Operation of the Milford eft? Tree Board The City Tree Board shall choose its own officers, make its own rules and regulations in accordance and in compliance with applicable law, and keepajorrwdof ite wrocecdings. Tree Species to be Planted The City Tree Board shall develop and maintain a list of desirable trees for planting along streets in three size classes based on mature height: small (under 20 feet), medium (20 to 40 feet), and large (over 40 feet). Lists of trees not suitable for planting will also be created by the City Tree Board. Section 8. Spacing The spacing of Street Trees and park Trees will be in accordance with the tree species sie classes listed in Section 7 of this ordinance, and no trees may be planted closer together than the following: small trees. 30 feet medium trees. 40 feet: and large trees. 50 feet: except in special plantings designed or approved by a landscape architect. Section 9. Distance from Curb and Corners and Fireplugs of any fireplug Section 11. Utilities No Street Tree or Park Tree other than those species listed as small trees in Section 7 of this ordinance may be planted under or within 10 feet of any overhead utility wire. Section 12. Approval process. The Planning Commission shall recommend approval of the Lot Line Adjustment to the City Council if it finds that the adjustments comply with the physical development standards, the laws of the State of Utah and the rules and regulations of Milford City. The City Council may then give final approval of the Lot Line Adjustment. SECTION 3. Effect of Ordinance. This ordinance shall supersede any previous Code or Ordinance dealing with the same subject matter. SECTION 4. Effective Date. This Ordinance shall take effect November, 1997 by the following immediately upon publication or posting. It was moved by Commissioner seconded by Rollins, and Marshall Commissioner unanimous!)' passed to approve the minutes. Gary Cornell and Ron State Lands and from Larsen. with the Board to met Forestry, discuss financing of wildland fires. Mr Cornell explained that the State of Utah will pay all costs above 5 of the County's general property tax collections, if the County will pay the 5 will meet with cost. Mr. the Clerk to work out details on payment of the 1996 fires. bills from the Outstanding Beaver Ambulance and Fire Departments will be paid out of the 5 monies. Merill Yardley, Clark Gerald Nowers, Bradshaw, Robert Yardley, Marilee Eyre, Chris Eyre, Mark Yardley, S.K. Nowers and John Messer met with the board to discuss a land exchange proposed B.L.M. lands near involving Sulphurdale. The Board stated that the County will oppose the exchange and send letters within one week. The County will send copies of the letter to any requesting party. Sheriff Ken Yardley met with the Board to request authority to hire a replacement deputy sheriff. It was moved by Commissioner Rollins, seconded by Commissioner Marshall and unanimously approved to hire Dale Maples. The clerk presented the 1998 tentative budget for the Board's review. A special meeting was set for November 24, 1997 at 1:00 P.M. to further review the budget. Effective Date. This Ordinance shall take effect immediately upon adoption of the City Council of the City of Milford, Utah. Passed by the City Council of Milford. Section 15. Dead or Diseased Tree Removal on Private Property The City Tree Board shall have the right to cause the removal of any dead or diseased trees on private property' within the City when such trees constitute a hazard to life and , property-- or harbor insects or disease which constitute a potential threat to other trees within the City of Milford. The City Tree Board will notify in writing the owners of such trees. Removal shall be done by said owners at their own expense within 60 days after the date of service of notice. Inthe event of failure of owners to comply with such provisions, the City of Milford shall have the authority to remove such trees and charge the cost of removal to the owner's property tax notice. . Milford City Zoning Ordinance, dated November 4, 1997 and published in loose leaf form by authority of the governing body is hereby adopted as the Zoning Ordinance of the City of Milford. The Milford City Zoning Map attached to the Zoning Ordinance is hereby adopted as the Milford City an appropriate deed if: No increase of dw elling lots A. or housing units results from the lot line removing Street Trees or Park Trees within the City of Milford, Utah, without first applying for and procuring a license. The license fee shall be in accordance with current license fee schedules of the City, paid in accordance to the licensing ordinance of the City, provided, however, that no license shall be required of any public service company or city employee doing such work in the pursuit of their public service endeavors. Before any license shall be issued, each applicant shall first file evidence of possession of Lability insurance in the minimum, amounts of $300,000 of bodily injury and $100,000 property damage indemnifying the City of Milford. Utah or any person or or damaged injured property resulting from the pursuit of such endeavors as herein described. Review bv City Section 19.
