D NORMAND GARCIA Ahora Utah Debido a un cambio de fecha para la pnixima audiencia fijada por un juez federal, la ley HB497 continuara suspendida temporalmente, segun lo inform6 a Ahora Utah la abogada Shiu-Ming Cheer del Centro Nacional de Leyes de InmigraciOn (NILC). De acuerdo con Cheer, la audiencia que estaba prevista para el 14 de julio fue postergada hasta el 2 de setiembre debido a la complejidad del caso y porque tanto la parte demandante como la defensora necesitaban mas tiempo de preparacion. "Esto es algo tipico en el sistema judicial debido a que, como abogados, trabajamos en otros casos y necesitamos mas tiempo para redactar mejor nuestros argumentos", dijo Cheer. La HB497, que debi6 entrar en vigor a partir del pasado 10 de mayo, fue suspendida temporalmente —hasta una nueva audiencia— horas mas tarde ese mismo dia debido a una demanda establecida por la Union Americana de Libertades Civiles (ACLU) y NILC en contra del Gobernador de Utah Gary Herbert y el Fiscal General Mark Shurtleff. El Juez del Distrito Clark Waddoups dijo en aquel fallo que encontrO suficientes evidencias como para pen- sar que la ley podria causarle daflos irreparables a una porcion de la poblaciOn. La HB497 fue impulsada en la Legislatura de Utah por el Representante Stephen Sandstrom, republicano por Orem, y requiere que la policia local verifique el estatus migratorio de quienes sean acusados de felonia —delito mayor— de categoria A, pero deja a Rep. Recientemente Sandstrom dijo en una audiencia organizada por un grupo estudiantil republicano de la Universidad del Valle de Utah (UVU) que el gobierno del Presidente Barack Obama revisO los estatutos de la HB497 y rehus6 desafiarla en corte, por lo que para el legislador esta ley esta redactada de manera correcta y constitucional. Por su parte, la abogada Cheer refiri6 que como demandante tiene "mucha fe de que la medida cautelar vaya a darse a favor de ellos". Dijo ademas que anteriormente NILC habia logrado ganar casos similares en Georgia e Indiana. Archie Archuleta, presidente de la CoaliciOn de la Raza de Utah e integrante de la parte demandante en contra de la HB497, dijo que por recomendaciOn de los abogados de ACLU aim no puede ofrecer ninguna declaraciOn a la prensa. No obstante, el activista Tony Yapias, director del Proyecto Latino de Utah, serial6 que desde un comienzo se sabia que la lucha en contra de la HB497 "seria un largo y dificil camino". "Lo importante es que ahora esta ley ha sido postergada, y eso le da un poco de tranquilidad a la comunidad", dijo el activista. Sin embargo, agreg6 que el retraso en la audiencia significa que el estado todavia no esta listo para defender la HB497 ante en el Tribunal Federal de Estados Unidos en Salt Lake City. "El 10 de mayo vimos que los abogados del estado no estaban lo suficientemente preparados y carecian de argumentos", dijo Yapias. Para Jose "Pepe" Gutierrez, presidente de la CoaliciOn Hispana de Utah, esta postergaciOn en la audiencia le da una esperanza a la comunidad inmigrante de obtener un resultado positivo. "Hemos conversado con los abogados de ACLU y ellos estan muy enfocados en lograr suspender permanentemente la ejecuciOn de esta ley", seflal6 Gutierrez. "Queremos conversar con los politicos dem6cratas y republicanos para encontrar una soluckin a este problema. Como comunidad, no buscamos leyes que signifiquen una amnistia, sino un reconocimiento al privilegio ganado por vivir en este pais", agregO. HB116 podria recibir apoyo de Sandstrom to Sandstrom y el Senador Curt Bramble, Republicano por Provo, estan estudiando la posibilidad de trabajar juntos para que la ley HB116 de trabajadores huespedes no sea abolida. Sandstrom, uno de los principales oponentes de la HB116, ha dicho que podria apoyar su implementacion si los legisladores de Utah aprueban una ley que sancione a quienes contraten a trabajadores indocumentados. El legislador intenta de esta manera que Utah siga los pasos de Arizona con la implementaciOn del programa federal E-Verify. Para Sandstrom, la implementaciOn de ese programa aliviaria las preocupaciones que tiene sobre la inmigraci6n ilegal. "Estoy dispuesto a negociar", le dijo en entrevista a Ahora Utah. Asimismo dijo que ambos legisladores conversaron telefOnicamente el 13 de julio para fijar una fecha de reunion. Bramble, quien se ha pronunciado a favor de que la HB116 sea aprobada en la Legislatura, dijo que aprovecharia una oportunidad de alcanzar un acuerdo. "Creo que hay espacio para la flexibilidad en ambos lados", indic6. Por otro lado, el representan- TESORO FISCAL ENCUENTRA INJUSTIFICADO' DISPARO POLICIAL CONTRA HISPANO EFE El fiscal de Salt Lake City declani "injusticado" el accionar de un policia de Utah que el pasado 24 de marzo dispar6 contra un inmigrante hispano, sin herirlo, cuando el hombre trataba de alejarse de un accidente automovilistico en el que se vio involucrado, inform6 la fiscalia de esta ciudad. Jared Cardon, oficial del Departamento de Policia de West Valley City, inicialmente declani que dispani contra Jose Alberto Contreras, de 21 arios, porque supuestamente este se proponia atropellarlo con su vehiculo. Pero, segim el fiscal Sim Gill, los testigos del incidente indicaron que Contreras estaba tratando de pasar por un lado de Cardon, no de atropellar al uniformado. Ademas, la reconstruccion de los hechos —basada en la posiciOn de los vehiculos y en la trayectoria del dispar—, revelO que Contreras no estaba manejando en direcciOn de Cardon, segim la informackin difundida por la fiscalia. El incidente sucedi6 cuando Cardon detuvo a un vehiculo en el suroeste de la ciudad, causando un pequerio congestionamiento porque el vehiculo detenido no dejaba lugar para que otros carros circularan. Aparentemente, al llegar al lugar de los automOviles parados Contreras no pudo detenerse, choc6 contra uno de los carros que estaba esperando el turno para pasar, retrocedi6, trat6 de girar en U y se chocO contra una cerca. La situaciOn caus6 la caida de una ciclista que transitaba por la zona y que sufri6 heridas menores. Un transeimte tratO de detener a Contreras pero, segim testigos, este "se alej6 de tal manera que puso en peligro la vida" de la otra persona. Cardon entonces intervino, pidiO refuerzos y dispar6 tres veces, una vez contra una de las ruedas del vehiculo de Contreras y las otras dos contra el sospechoso. Contreras tratO de darse a la fuga, pero fue arrestado poco despues. El 2 de junio pasado se lo acus6 formalmente de intento de homicidio, de asalto agravado y de no responder a las Ordenes de un policia. Sin embargo, ahora que el accionar de Cardon fue declarado injustificado el18 de julio, es posible que cambien tanto la situaciOn legal del agente como la de Contreras, segim el fiscal Gill, debido a que el policia podria ser acusado de usar su arma de manera ilegal, mientras que Contreras, que sigue detenido, podria ser absuelto de alguno de los cargos en su contra. Gill dijo que el analisis legal aim no ha sido completado y que el Departamento de Policia de West Valley City esta realizado una revision interna de los hechos. Mientras se completan esos procedimientos, Cardon seguira en vacaciones administrativas. Esta es la segunda vez en julio que el fiscal Gill declara injustificado el use de armas de fuego por parte de un policia en Salt Lake City.
