Provided that where he said company has double tracks on the same street and it be required for the accommodation of some other corporations or person to lay its tracks a greater distance dis-tance apart than it would be required too to-o but for the accommodation of such other corporation or person then in that vent the said railroad company shall noS be liable for or required to pave such adJ ditional distance Sec 4 The price of a single passage within the city limits shall not exceed five cents and no charge shall be mode in ex ess thereof excepting where the passage > r some portion thereof shall be over any part of the line of the grantee lying within he limits of Fort Douglas military reaer atlon so long as said reservation shall exist and in case Its boundaries shall hereafter here-after be reduced In area the above excep ion shall apply only to such area Sec 5 The grantee shall be liable for all accidents to people or Injury to prop arty whether of the city or private parties In the construction and operation of Its aid railroad occasioned by its misconduct negligence or default and particularly in he use of electricity thereon and the said company shall at all times be required to use such reasonable and approved methods as are then In successful use by cities of approximately the same size as Salt Lake city and as shall at any time be reqaested by the city council and the board of public works for the protection of the public and its property against Injury caused by the use of electricity as motive power and 11 deemed necessary by the said city council and the board of public works the said company shall have make and maintain a complete metallic circuit of such approved ap-proved kind as shall be used and adopted and proven by experience to be proper and reasonable Sec 6 The rights and privileges hereby given and ail restrictions and limitations herein contained shall be deemed a part of and run with this grant and shall be operative so long as the privileges and franchises herein given shall exist and lit case the corporate limits of the city shall in the future be extended all tha lines ofi said company within the corporate boundary bound-ary as so enlarged shall become and ba subject to the terms and conditionsof the charters of said company as amended by this ordinance the same as if said lined were now within the corporate limits Sec 7 That all ordinances resolutions and parts thereof in conflict with the provisions of this ordinance are hereby repealed and the resolutions mentioned lot section 1 of this ordinance amended aa herein provided are hereby reenacted and v made operative from the date of thd passage of this ordinance Sec 8 If this grant benot accepted in writing by the grantee within 28
