An ordinance amending Section 55 of Chapter 26 of the Revised Ordinances of Salt Lake City, 1892, in rela- tion to smoke emitted from chimneys. Be it ordained by the City Council of Salt Lake City, Utah: SECTION 1. That Section 55 of Chapter 26 of the Revised Ordinances of Salt Lake City, 1892, be, and the same is hereby amended to read as follows: SECTION 55. It shall be unlawful for the proprietor, agent, lessee, occupant, engineer, or fireman of any building in which a boiler is or may be used for generating steam or electricity, or for any other purpose, to permit or allow smoke to issue or be emitted from the chimney or chimneys of such buiding, used in connection with such boier, within the corporate limits of Salt Lake City. Any proprietor, lessee, occupant, engineer or fireman who shall violate any of the provisions of this ordinance shall be deemed guilty of a misdemeanor, and, upon conviction thereof, shall be punished by a fine of not less than five $5.00) dollars, nor more than fifty ($50.00) dollars; provided, however, that the penalty' herein provided shall not apply in any case where the fireman, engineer, owner, lessee, or occupant has supplied such building with and shall have in use a sufficient device for the consumption or prevention of smoke; and provided, further, that this ordinace shall be held to apply only to such buildings in which may be used or operated a boiler or )oilers which either singly or in bat-- , eries are of the capacity of ten (10) lorse power or over, and provided, fur her, that it shall not be held to apply o ten (10) horse power boilers used City Recorder. t: By A.
