Salt Lake The three-maCounty Commission, sitting as the board of equalization, refused to exempt properties such as Deseret Gymnasium, as well as some other properties of religious and charitable groups and lodges. The boards action occurred last summer after Baker assessed the properties for tax purposes later than the states legal deadline in May. Officials said only the board of equalization could place the properties on the assessment roles late. . The assessor and his attor-leyalso paid by the county, sal in the petition that it should be considered before any ot .the 92 appeal hearings are scheduled. Successful arguing of Bakers petition would bring dismissal of all the appeals concerned and obviate any hearings later, the petition stated. The county commissioners ordered the others exempted in September but Baker refused and tax no- tices went to the religious and lod e owners the first of this month. Nemelka in an opinion written last summer challenged the commissioners authority in exempting properties maintaining they were limited to equalization of assessment valuations except on indigents properties.
