Show Revision needed on drug policy If a University student today is arrested, just arrested, not necessarily convicted, of possession of marijuana, the University through its Student Behavior Committee may under present policy expell or suspend the student. Is this double jeopardy? The University administration's usual answer is "of course not." But what is double jeopardy if not being "tried" twice for the same "crime"? Students have started to ask if they are not indeed subject to double jeopardy or being tried twice for the same crime when they must defend themselves before a civil court as well as the University's kangaroo court, the Student Behavior Committee. ! The University defends its double jeopardy policy by pointing out indignantly that they are obligated to determine membership in the University community in order to protect it. Administrators say, we can't have "undesirable" elements influencing our students. Our civil judicial system imposes sanctions to rehabilitate and reform individuals. Utah organized two institutions: one to enforce laws and one educate. Is the role of the education so simple he must now seek extracurricular activities by reviewing work of the law enforcement and judicial agencies? Why should the University perpetuate a police force and judicial system which deals with events that happen off-campus? Something is wrong when University administrators believe they must screen on a solely moral basis, applicants who have been cleared by institutions set up by law specifically designed to enforce the law, pass judgement and rehabilitate offenders. If courts believed that those who violate marijuana laws are not fit to be members of a University community, they should stipulate this. If courts ; decide that an individual is rehabilitated, this person should ! not be submitted to the humilation and harassment of ! another hearing. The Chronicle recommends the University revise its drug policy to eliminate its interference and contradiction with I the proceedings of courts.
