Show I RS ARE They Will Test Law TaKing Away Money Mon Allowed for Mileage When They Ride on Passes A suit will undoubtedly be started within a few days to test the validity of of certain portions of the legislative appropriation bill relative to District i court stenographers and the District 1 Attorneys providing that mileage allowed allowed al al- lowed by the State shall have been actually actually actually ac ac- ac- ac paid Stenographers throughout the State declare that this is an imposition and many have threatened to resign The Di District Attorneys have said but little It is understood that the stenographers will will fight the provision and that at the same time the case may be applied to the same condition that exists relative to the District Attorneys Under title 74 of the Revised Statutes Statutes Stat- Stat utes of 1898 it provides for a s ste ste- stenographer e- e for the District court It allows Judges of various districts to contract for the employment of a a. court stenographer who shall be allowed mileage for distance covered of not more than 10 cents a mile and a per diem iem char charge o of not ot more than 8 a day In this section nothing is said about the actual payment for lor transportation but hut is simply for the tho expense of travel travel- ing lug The last fast Legislature sou sought ht to tomake ma make Ite the State the beneficiary of passes allowed any of its employees and andIn andin in appropriating ting for the stenographers stenographer's ste ate expenses for the next two j years ears had this clause inserted For actual mileage and per diem of stenographers for ten districts forthe for forthe forthe the calendar years 1907 and 1908 or so much thereof as may be necessary provided pro- pro vided however that no mileage shall bo be charged against the State where free transportation is used It is contended that most of the outside outside outside out out- side stenographers have passes that are secured upon their own responsibility and ad in in no way connected with the State They assert that the statute under up un un- der which the they are aie working does not require that it shall be for actual transportation paid for The stenographers have been waiting for an opportunity to arise by which they could start suit an ana ancl l recover whether the transportation was paid for or not I At a recent meeting of the State Board of Examiners a stenographers stenographer's bill for transportation was turned down because it was not shown that I. I i the was actually paid pai for by the stenographer It is upon this action ac cc- tion that suit will be commenced and an effort made to test the legality of th the terms in the appropriation bill |
