saturday bryan wimmer oisen and tuttle being absent A communication was received from the governor notifying the council that he had approved and filed with the secretary 0 T memorials aos 2 and 3 in relation to the alien land act and the appointment of a fourth associate justice for the territory the following communication from the auditor of public accounts was read and referred to the judiciary committee with instruction to investigate hon E JL smith president and members of the legislative assembly gentlemen I 1 desire to call your attention to chapter 7 of the laws of 1886 entitled an act for the benefit of territorial prisoners released from the penitentiary it will be seen that under said act the warden of the penitentiary is authorized to draw money from the treasury without first obtaining an auditors warrant all claims against the territory should be first presented to the auditor and if payable a warrant will issue which will be redeemed by the treasurer out of any funds in his hands this has been the custom and is the correct one as under any other system it would be impossible for the auditor to keep an account with treasurer as the law requires I 1 would therefore suggest that be drawn on the order of the S marshal on a certificate specifying in substance the facts amder which the claim is made said certificate should cover the points mentioned in referred to committee the municipal corporations gohd towns mr shurtliff introduced C F no 16 a cities and towns to borrow money for certain purposes the bill was read for the first time and referred to the committee on and towns following is the text of the bill BE IT ENACTED by the governor and legislative assembly of the territory of Utah that any incorporated city or town in this territory may for the purpose of supplying its inhabit ants with water sowers or making other public improvements borrow money as a direct loan to any amount in the aggregate include ing existing indebtedness not exceed per on the value of its taxable property to be ascertained last assessment for territorial and county taxes next preceding the incurring of such indebtedness or irmay issue bonds to any amount including existing indebtedness noc exceeding four per on the value of its taxable property to be as aforesaid payable at such times and places within twenty 20 years and bearing auch rate of interest not exceeding seven por cent per annum is its council or trustees may deem for its best interest and may provide that such bon ds tadd by them such bonds diall not bo sold for less than their par amount in the aggregate existing liabilities noc exceeding 4 er cent on the value of its taxable property to be ascertained from the lost assessment asse for territorial and county taxes next preceding the incurring of said indebtedness or it may asrue bonds to adv amount in indebtedness not ex j beeding 4 per cent on the value of its taxable property to bo ascertained acs payable at such
