to the southwest comer of parcel South ROW Line of 200 North ST City Survey located in the SE 14 of Section 33 Township 12 North Range 1 East Thence north 296 feet i Thence east along the south ROW Line of 200 North ST to the POB The Ordinance describes the intent and purposes of foe City CouncH in adopting the Project Area Plan which include but are not limited to: (a) removal of structurally substandard buildings impediments to land disposition and development through the assembly of land permit the return of foe real property located within the Project Area to economic use and new construction rehabilitation of buildings and encourage and accomplish the removal of blight and blighting influences from the Project Area (b) eliminate environmental deficiencies and promote and market the Project Area for development and provide as funds are available through public or private sources improved access traffic circulation pedestrian circulation utilities streets curbs sidewalks parking areas landscaping transportation and other infrastructure improvements to improve foe Project Area and attract development (c) promote foe implementation of community-develope- d goals applicable to the Project Area such as the Logan General Plan and foe Future of Downtown of the Act Logan Plan and (d) provide for the strengthening of the tax base and implement the tax increment financing The Ordinance incorporates the Project Area Plan by reference and the City CouncH recited in foe Ordinance the determinations and findings of the Redevelopment Agency of Logan CHy as follows A There Is a need to effectuate a public purpose and implementation of the Project Area Plan would accomplish the public purposes set forth iri the Act including but not Hmited to the elimination of blight blight factors and blighting influences within foe Project Area B There is a public benefit which would accrue through the adoption and implementation of the Project Area Plan C It is economically sound and feasible to adopt and carry out the Project Area Plan D The Project Area Plan conforms to Logan City's general plan E The Project Area Plan would develop foe Project Area in conformity with the Act and carrying out the Project Area Plan will promote the public peace health safety and welfare of Logan City F The use of eminent domain Is or may be necessary to the execution of the Project Area Plan G Adequate provisions have been made for just compensation for property acquired by eminent domain ' H The Agency has a feasible method or plan for the relocation of families and persons displaced by foe Agency from the Project Area I Comparable dwellings exist or will be provided to the families and persons displaced by the Project Area Plan As used in this Subsection I 'comparable dwellings' means residential housing facilities that are: (0 within the project area or in Other areas not generally less desirable in regard to pubfic utilities and public and commercial facilities (H) at rents or prices within the financial means of the famines and persons displaced from the project area and (iii) decent safe and sanitary and equal in number and available fo displaced families and persons and reasonably accessible to their places of employment J The Agency Board is satisfied that permanent housing facilities will be available withki three years from the time occupants of the Project Area are dis placed by foe Agency if any and that pending the development of these housing facilities there will be available to the displaced occupantej if any adequate temporary housing facilities at rents comparable to those in the community at foe tifne of their displacement K The Agency Board previously made and adopted its findings of blight entitled “Resolution of foe Board of Directors of the Redevelopment Agency of the City of Logan Pursuant to UCA Sections and Making a Finding of Blight Regarding the Proposed Downtown Redevelopment Project Area finding and determining among other things that the Downtown Redevelopment Project Area is a blighted area pursuant to the provisions of the Act because of the following factors: (The Ordinance describes detailed information in support of the existence of each of the following - ' 17b-4-6- factors) uses resulting in obsolescence deterioration or dilapidation Economic deterioration or continued disuse - shape or inadequate size for proper usefulness and development or laying out of lots in disregard of foe contours and other physical characteristics of foe ground and surrounding conditions Lots of irregular finding of bHght is August 20 2003 The Ordinance recites that the acquisition of property by the Agency by condemnation is provided for in Project Area Pldh and the Ordinance specifically incorporates the provisions of tax increment financing as permitted by the Act providing for the Agency to receive tax increment from the Project Area i The Ordinance and Project Area Plan contemplate that the Agency wifi adopt a Project Area Budget after approval thereof by the Taxing Entity Committee as required by law The Project Area Budget was approved by the Taxing Entity Committee and also has been adopted by foe Agency The adopt allows the Agency to receive 100 of the tax Increment monies from the Project Area for a period not to exceed fifteen (15 ed Project Area I years of the Act the Agency Pursuant to the provisions of Sections and Agency to be used for certain housing purposes as set forth in the Act 17B-4-5- 17B-4-10- -
