Gustaldi was held to answer to the district court by Justice Saunders of Mammoth precinct, and Tuesday argument was had by the attorneys on application or a writ of habeas corpus and admission to bail. The stenographer did not have the transcript out, and county attorney Foote argued that the transcript would show that the testimony the def e n d a n t against was much stronger at the second preliminary examination than at the first. Judge Powers argued that when a defendant was once admitted to bail on the same charge, that the courts held that the defendant would be entitled to bail, and asked that the bond be fixed at $3,000 instead of $7,000 as formerly, for the reason that two of the bondsmen had gone to Heber and couldn't be reached, and alto for the reason that the defendant had always held himself amenable to the orders of the court and been present. Judge Greenwood took the matter under advisement un til the 20th inst. in order that he might read the transcript. At the session of the district court held here Tuesday, the order of sale of certain property of the T. J. Schofield estate, which was signed by the court on Feb. 3th, was ordered vacated for the reason that Feb. 13th. was holiday, the law being that when a holiday (Lincoln's birthday) occurs on a Sunday) the oilowingday shall be the holi day.
