Show CHAPTER XXV "v fl .OF LICENSE'S M An ACT authorizing County Courts to grant Licenses. Section 1. Be it enacted by the Governor and Legislative Assein- k bly of the Territory of Utah: That on and after the first day of April, iH eighteen hundred and eighty-four, no person shall be permitted to " carry on the business of merchants, retailers, peddlers, auctioneers, brokers, pawnbrokers, money changers, travelers, traveling showmen, . theatrical performances, circus, and menageries, without first obtain- AH ing a license therefor from the county courts in their respective conn- 'H ties, as hereinafter provided. i Sec. 2. The county court in their respective counties are hereby authorized to provide for the granting of licences, as contemplated m . n the first section of this act. They shall also provide a suitable book 1 of printed forms with stubs, said stubs shall contain a duplicate copy of all licenses issued, and they shall be numbered consecutively; said JB county courts shall fix the price of all licenses granted by them, which. price shall be uniform for all licenses of the same class and shall not. pBM exceed for any one license on any business named in this act the sum HH of one hundred dollars for any one year; Provided, That the price fixed for a quarter yearly license may be made the price for any time less than three months; and said county courts shall require pay- ment for all licenses invariably in advance. Upon the applicant pay- ing the required; amount to the county clerk, said clerk shall issue tl e - ""B requred license for any term not exceeding one year. ; . . J Sec. 3. No such license shall be transferable, unless such transfer H shall be sanctioned by the county court or probate judge. 'H 3ec 4 if aily person shall violate the provisions of any of the pre-ceeding pre-ceeding sections of this act, he shall be guilty of a misdemeanor. :j lM Sec. 5. -Nothing in this act shall be construed to apply to peddlers of perishable fruits and vegetables, nor ,to any person carrying on 'M business in an incorporated city. - JH i Approved March 13, 1884 - V .... . PUESUANT to the provisions of an Act of the Governor and Leg-islative Leg-islative Assembly of the Territory of Utah, entitled "An Act author-izing author-izing County Courts to grant licenses," approved March 13th, 1884- It Hi is ordered by the County Court of Washington County that every M person, firm, company or corporation who wishes to obtain a license to carry on the business of a merchant, retailer, peddler, auctioneer, I 91 broker, pawnbroker, money changer, traveling showman, or to exhibit HH : theatrical .performances, circus or menageries in Washington County, must make an application therefor, in writing, to the Clerk of the Court, under oath; such application must state the name of the per- ' -H son or persons who intend to carry on the business, or if it be a. com- pany, firm or corporation, the names of tho members or firm name-or , J the name of the corporation, tho placo where the business is intended 'j to bo carried on, and with convenient certainty the amount of capital H intended to be -used. Five Hundred f 'W dollars, tho sum of 86.25 per quarter yearly, in advance. If the license sought for be for ah auctioneer, the sum shall be $12.60 per quarter yearly, in advance. B If the license sought for be for any other business mentioned in B said act, the County Court on application will make special rates therefor.
