" Granting to Jesse Knight a franchise and right-of-way for the construction construc-tion and operation of a railroad, including in-cluding poles and wires, through and upon the streets of Pleasant Grove City, Utah. BE IT ORDAINED BY THE CITY COUNCIL OK PLEASANT GROVE CITY. UTAH: , Section 1. That Jesse Knight, his successors and assigns have the authority au-thority and consent of i leasant Grove City, and a franchise and right-of-way is hereby granted him to construct, operate and maintain a single or double dou-ble track railroad, together with all the necessary switches, wye, turnouts, side-tracks and other accessories for the transportation of ' passengers, freight, express and mail car, and to erect and maintain a line of poles or two lines of poles when necessary, and maintain thereon telephone, telegraph, tel-egraph, trolley, power and other electrical elec-trical transmission wires for the accommodation ac-commodation of said railroad, and otherwise as a continuous line through "laid eft?', upon such streets and parts of streets as may ' selected by said grantee, or his successors or assigns, within twelve months from the passage pass-age of this .ordinance, which said selection se-lection shall be made in writing and filed with the city recorder. In consideration of this grant and franchise, the said grantee, his successors suc-cessors and assigns, herehy agrees to use T rails in the construction of said railroad, and where said railroad is constructed or operated upon pav 'd Streets are hereby required to keep in good repair and pave with brick or stone, or other goixl material to be mutually agreed upon, the space inside in-side the track or tracks, and a apace two feet wide on each side of the same, including all spac-cs between double tracks where the same are con Strutted. Steam shall not be used as a motive power in the operation ( said railroad, except in the construction construc-tion thereof, and (or the iiiovwiirtH of obstructed and disabled cais thereon, there-on, and for the clearance of said rail road from any obstruction whatewr. whenever electric or other motive lower shall be inadequate and un eipuil in the occasion. M. the t.n k or rtfl- to lie ressors and assigns, t5 hold said city. harmless iromand agamstnv and all liability, loss, costs, expense, or damage Yom any cause arising out of am such default or misconduct, which may arise by reason of any ac cident or injury which may occur, in or by reason of the construction or op eration of said railway, and to indem nify and repay said city for any loss cost, expense or damage of any kind it may sustain by reason of any such default, misconduct, accident or in jury, and if any judgment for dam age for any such default, misconduct accident or injury shall be recovered against said city, the recovery thereof shall be final as between said city and the said grantee, his successors or assigns, and conclusive as to the liability li-ability of the latter to the former, pro-yidedhowever, pro-yidedhowever, that the said grantee, his successors or assigns, shall have had notice in writing of the pendency of such action in time to appear and answer the same, and an opportunity afforded them by said city to join in the defense thereof. Sec. 7. That if this grant with the terms and conditions herein contained be not accepted in writing by said grantee, his successors or assigns, within !0 days alter the notice of the passage of this ordinance, or if the preliminary survey of snid railroad be not commenced within six months af ter the passage of this ordinance, or if the construction of at least one track of said railroad be not completed through the city within two. and one-lialf one-lialf years after the acceptance of this ordinance, then' this grant and franchise fran-chise shall become null and void; provided, pro-vided, however, that said grant and franchise shall not be forfeited for the causes above set forth, or for any reason rea-son whatever, if the said grantee, his successors or assigns, without his fault, shall have been prevented, hindered, hin-dered, or delayed in the performance of said conditions or any of them 'by the act of God, or the operation of law strikes, or other causes beyond their control.
