Show r CASE OF TREASURER t BOLLN OF OMA HA City Attorney Thinks lie Should Not Be Punished C COMPOUNDING A FELONY HE HAS MADE GOOD ALL HISS HIS-S STEALINGS City AV1I1 Not Lose a Dollar 35c cause at Bollns CrooUert Work Neither Will His Bondsmen nml for This Itcro > m It Is Alleged lie Should Xot Be 1roseciitetl Omaha June 30 There is much discussion dis-cussion in Omaha as to whether or not defaulting Treasurer Henry Bolln shall be prosecuted The record shows that at least 25000 of the city funds were missing when Bolln was deposed As this was made good by the bondsmen bonds-men and the city lost nothing some w re in favor of letting Bolln escape further prosecution But a most remarkable re-markable feature of the case was mad public today when a letter from Acting City Attorney Cornish to the mayor was printed He boldly declares de-clares in favor of compounding a felony as follows Omaha Neb June OGeorge P Bemis Mayor City Dear SirIn response to a request for information as to your legal duty in the matter of Henry Bolln city treasurer permit me to state that nowers onferred upon ama a-ma r and penalties provided by law are intended to subserve a useful purpose pur-pose and not as a means of persecution persecu-tion That Mr BolIn has violated the lav is beyond question It should be also remembered that BolIn has lived in this city for thirty years up to two months ago no man had a better reputation rep-utation for integrity than he and no official a better record in the performance perform-ance of his official duties than Bolln If a reputation is to avail anything it ought to be in a circumstance like the present Now he has lost his f reputation his record in office during several terms past is sullied his property prop-erty is all turned over to his bondsmen bonds-men his means of livelihood is suddenly sud-denly cut off and his sufferings are alien as but few endure To attempt further punishment would look more like persecution than the performance of dlty You should endeavor to disregard the harangue in the city council and the paragraphs in the newspapers all tf which are evidently intended to work up sentiment favorable to various vari-ous political movements this coming fall l fallIn In the case of Henry BolIn there are a nrmber of extenuating circumstances circum-stances There is no evidence thus i far that any record has been mutilated I mutilat-ed or falsified in the least The shortage f short-age in the office appeared in the first hour of the investigation the same as after a complete and thorough investigation inves-tigation Ther was no attempt to l cover or hide a single act Had Bolln I intended to steal there would have r been attempts to cover and conceal all of which are lacking in this case Had I such been his intention there is no reason why his shortage should not have gone up into the hundreds of I thousands instead of as it really is It is now evident that not only will the city not lose a dollar but even Bollns bondsmen are not likely to lose a dollar in this matter And I do not think BolIn should be further punished pun-ished No steps have yet been taken to ar rest Bolin If one warrant is issued S many others must be for many poli ansareguilty of participating in |
