Show i GET VERDICT BY STRIKING AN AVERAGE If the contention of the Utah T.ight and Power company In Its motion for a new trial In the suit of Carl Ouasch, who sued for loss of an aim against that company, be correct, a rather unique manner of assessing damages has been brought to light. It Is claimed by the railway company, and the claim Is supported by affidavits of two Jurors, that every member of the Jury assessed the damages at a different um, ranging from $10,000 to $78,000. As they were unable to agree upon an amount. It was suggested that the estimates esti-mates of the various Jurors be added and then divided, the sum resulting to be assessed as-sessed as damages. In this way they took the mean of all the sums suggested, which amounted to J12.&00, and brought in a verdict for that amount. |
