The same day the county made a reply to said answer denying that the lands taken for the road would be damaged, but on the contrary would be improved in value by the construction of the new Federal Aid Highway. The complaint would have been filed earlier, but at one time it was not expected that the injured person would live, which would have resulted in the filing of a first degree murder charge, but in view of the fact that he is improving now, the present charge, which carries a minimum of five years in the State Prison, is filed.
