Other Published in Beaver County Monitor February 27, 1997 UNAPPROVED MINUTES MILFORD CITY COUNCIL February 18,1997 Mayor Mary Wiseman called the meeting to order at approximately 7:00 p.m. Those in attendance were: Council members Junior Davis, Nick Swain, John Carter and Mark Dotson. Attorney Leo Kancll, Treasurer Arden Fowles. City Manager Nedra Kennedy, Foreman Ray Whiting, City Engineer B.J. Moore, Beaver County Commissioner Gary Sullivan, John Leko, Don Ostler, Katie Elmer. Alan Durrant, Erik Jacobsen. Alice Smith reporting for the Beaver County Monitor. flop Ostler - Circle Four Fam Violation Don Ostler gave a report based on concerns expressed over the Circle Four Farms potential pollution of ground water at the hog production facility. Mr. Ostler reported Circle Four Farms had received Notice of Violation and Order with a penalty of He S6.800.00 being assessed. the on disinfecting process reported and the sampling procedures mentioning the absence of bacteria evidence found in samples taken. Safe conditions of nitrates had been detected. Circle Four Farms will continue to sample the well and w ill begin to sample the deep aquifer. Mr. Ostler reported the first concern would be if any other wells were impacted. Alter consulting with the Safe Drinking Water and Department of Heath they did not feel a reasonable risk to any other wells. Council expressed their desires to receive all documentation concerning any contamination. Mayor Wiseman stated the Council felt Circle Four Farms would be prompt in the future on their reporting. Councilman Nick Swain requested a formal invitation to the Milford Valley Water Users Commissioner Gary meeting. Sullivan suggested contacting Keith James to inform him of this request. City Manager Nedra Kennedy will draft a letter to Mr. James concerning Milford City's attendance at this meeting. Discussion concerning the permitting process brought many concerns. Mr. Ostler told the Council the State did not permit the buildings, the and their only lagoons construction. The Beaver County Planning and Zoning Committee issued the Conditional Use Permits for the buildings. Erik Jacobsen - Circle Four Farmi Erik Jacobsen approached the Council to request the appointment of one member of the Council to meet with himself. Craig Davis and Doug Carriger on a monthly basis to communicate Circle Four Farms progress and tour their sites. Nick Swain was appointed as the contact and w ill report to the Council. Bills and Payroll Councilman John Carter motioned to approve the bills and payroll as presented. Councilman Russell Smith seconded the motion, all were in favor. Hospital Board Meeting Delegate Mark Dotson will act as the Milford Hospital Board delegate at the annual board meeting to be held February 2 1 , 1 997. John Carter will act as alternate delegate. Lifeguard Applications Councilman Russell Smith requested changes be made to the procedures for hiring of temporary employees and felt he should have been involved in the hiring process of the lifeguards, Council members stated their concerns but felt the individuals had been hired and the hiring should stand. If individuals want to be enrolled in the class they could do so at their own expense. Councilman Russell Smith will choose two more !?jndrvidAwj8,tp afle4.tfe pcrlatioo, Councilman Junior Davis motioned to approve the hiring of Melissa Rose, Natalie Nelson, Shelby Holm, Chatys Lamb, Abby Carter, Cheryl Barnes, Sara Jefferson and Lindsey Barnes Carter's per Jennifer recommendations and in the future the pool manager and councilman in charge of recreation will review applications together, Councilman Nick Swain seconded the motion, all were in favor. Councilman Nick Swain motioned to change the hiring policy for close family members of supervisors, other individuals should make the choice in order to avoid conflicts. Councilman Mark Dotson seconded the motion, all were in favor. Water Source Protection Plan Councilman Mark Dotson stated the plan had been rejected by the State with no explanation. Ray Whiting will contact the Department of Environmental Quality to receive information on the review process. Milford Committee City Ordinance Councilman Nick Swain motioned to approve the appointment of Deb Thompson. Todd Baxter. Phyllis Mayer, Norm Lamb, Larry Barnes, Joan Long, D.A. Symond. Mary Wiseman, Nick Swain and Nedra Kennedy to a committee to review present city ordinances. Councilman John Carter seconded the motion, all were in favor. Conditional Use permit - Circle Four Farm? A Public Hearing of the Beaver and Zoning County Planning Committee will be held March 5, 1997 at 7:30 p.m. in the Milford High School Auditorium to hear comment on Circle Four Farms proposed Boar Stud facility west of Milford. Planning and Zoning committee has requested the make comments on the proposed facility as the location is approximately 4 miles from the Milford City limits. Councilman Mark Dotson stated the city did not have to protest the conditional use permit because they had protested septic tanks in the Antelope Ridge Annexation. The city Is required by the EPA to identify any source of potential pollution and incorporate into a Source Protection Plan. When for water loans from DEQ improvements lo the city were received they city was responsible to identify any septic tank in the and not allow further septic tank permits be issued. Councilman Nick Swain stated Milford City has a right to be concerned about the potential water pollution no matter what source and odor from Circle Four Farms. He stated the members have a right to be concerned about the possibility of water pollution and odor and should ask that that be included in all Conditional Use Permits for Circle Councilman Mark Four Farms. Dotson stated that if we monitor one industry- the city is obligated to monitor all industries. If not prepared to do that the city should be prepared for a lawsuit for harassment. Councilman Nick Swain motioned to draft a letter to the Beaver County Planning and Zoning asking them to consider water quality and odor when issuing a Conditional Use Permit. City office staff was instructed to contact the Beaver County Sheriff Kevin concerning department Anderson's zoning violation. Council requested citations be Issued for the violation. Councilman Russell Smith seconded the motion, all were in favor. 2-- Staff Comments Attorney Leo Kanell reported the Notice of Service has been received back from Carbon County Sheriff Department concerning the Monfrcdi property. The notice was served on January 30, 1997. Mondredi's have 30 days to bring the structure up to standards. Councilman John Carter motioned to approve the submittal of the Water System Master Plan to the Drinking Water Board as presented by B.J. Moore, Councilman Mark Dotson seconded the motion, all were in favor. Attorney Leo Kanell reported on damage to the Senior Citizen' Center from leaking roof. He will contact the building inspector to look at the damages and determine what action should be taken. Councilman John Carter motioned to authorize B.J. Moore, Nick Swain. Arden Fowles and Nedra Kennedy to attend a two day seminar on March 8 in Richfield on planning, zoning and financial issues. This position individual w ill bring suggestions' and information from the Milford Flat residents. John Leko will be appointed and w ill attend all council meetings. Councilman Mark Dotson motioned to draft a letter to Advanced Development requesting they gravel the streets in the Lewis Addition for a temporary repair until the streets can be improved. Councilman Nick Swain motioned to authorized City Manager Milford City Planning and Zoning meeting w as held on January 8, 1997 at 7:00 P.M. in the Milford City Office. The following members were present: Cynthia Webb, Sheldon Albrecht. Nick Swain, Keith Long. Allan Durrant, Gary Malchus. and Donald Willden. Also present was Arden Fowles and B.J. Moors. Item 1: Kevin Anderson made a request for a conditional use permit for his trailer park. Letter that was prepared by Glen Hill was read, stating the conditions at the park and also presented some concerns at the Motion by Gary Malchus, park. seconded by Allan Durrant that the conditional use permit be denied. Voting was unanimous. Next step options available were explained to ! Mr. Anderson. r Mark Dotson, 2: Item representing Twin Mountain Rock, requested a conditional use pennit that would place a trailer that will serve as a temporary business office space in the North Star Trailer Park. The request has the approval of the park manager B.J. Moore. Motion by Keith Long, seconded by Sheldon Albrecht to approve conditional use permit with the conditions that all codes be met and the permit not to succeed the length of one year. Office space for the superintendent and the secretary. Item 3: Reviewed draft of new ordinance. zoning Recommendations and changes will be sent to Curt I Iutchings. A number of items will also be sent to Curt for clarification. Item 4: Donald Willden made the recommendation that the agenda be sent to committee members prior to meetings and that an overview be prepared. SPECIAL MILFORD CITY PLANNING & ZONING MEETING Februarys, 1997 Special planning and zoning meeting was held on February 5. 1997. Meting was called to order at 7:05 P.M. The following members were present: Cynthia Webb, Gary Malchus. Nick Swain, and Donald Willden. Also present was Arden Fowles, Milford City Planning and Zoning Administrator. Item 1: Brian Warby met with the committee to request a use conditional for an permit Some autobody repair shop. discussion reviewing the conditions of the conditional use pennit were: sidewalk on the south, water meter, new asphalt, signs, and proper drainage.' Visitors: Allan Mayer, Joe Leko, Brenda Powell, Bill Powell, Ron Wunderlich, Warren Peterson, Eric Jacobsen, Normand & Sherrie Thompson, Bill Dalton, Nathan Ward. Chairman Lofland called the meeting to order at 7:33 p.m. MINUTES. The minutes of January IS, 1997 meeting stand approved. CONDITIONAL USE PERMIT. Bill and Brenda Powell would like to operate an ostrich farm, they would have approximately 550 ostriches. They own 40 acres, but would only use 14 of those acres. They discussed whether or not this would be considered an extensive livestock operation and notifying the property owners in the area. Johyn made a motion to table this until the next meeting so property owners can be notifies Jeff seconded the motion. Motion passed unanimously. CONDITIONAL USE PERMIT. Eric Jacobsen was there to discuss with the board Circle Four's request to operate a 400 Boar-Stu- d complex approximately 5 miles west of Milford City. It is a State school Section and is surrounded by BLM land, it is isolated but is still easily accessible, for roads and power. Johyn made a motion to table this until we can hold a public hearing in Milford to get public input. Jeff seconded the motion. Motion passed unanimously. We then discussed when to hold this public hearing. It was decided to hold it March 5, 1997. CONDITIONAL USE PERMIT. Nathan Ward and Billy Dalton were there to discuss Comnet CeUular's application to build a 12x20 prefabricated building and 180 ft. Guide tower on property owned by Billy Dalton They discussed where the property was located. Johyn made a motion to grant C.U.P. Alice seconded the motion. Motion passed unanimously. ITEMS OF DISCUSSION. We will review C.U.P.'s in March Ken read a letter from Milford City regarding the Circle 4 well incident Ken also read a letter from the Beaver County Commission requesting that the members of the Planning & Zoning Commission meet with them on March 3, 1997 at 7 p.m. Normand Thompson was there and told the board he had talked to Eric Jacobsen and told him that he was opposed to the Boar-Stu- d complex being located where it was, he thought it would be better to have it another mile further west. They discussed the nuisance ordinance and how to get property owners to clean up their property. If need be the county can go in and clean it up and bill it to the property owner on their taxes.
