A Washington upct-ia-l of yesterday to the Salt Lake Herald say: Rev. W. M. Paden of Salt Iaike is here to t.-- part in the prosecution of the case against Senator Smoot. He is of the opinion that the original protest which he took part In preparing, and numerous petitions which support will be effective in accomplishing the desired result. In an interview published today Mr. Paden says: There has been no charge that Mr. Smoot has violated the laws, except that he has winked at and encouraged practices which since 1S62 have been violations of specific laws. In that year congress passed an act making bigamy a crime in the territory of Utah. Practically every plural marriage now in existence was contracted, therefore, in direct violation of the law. This fact Smoot seems to have overlooked or forgotten." If the remainder of those who are proceeding aaglnst Smoot make the same admission that Dr. Puden does, that Smoot has not violated any law, the case, in the opinion of many senators, will be of short duration, despite the activity of the various religious and moral associations. Several senators who have heretofore remained silent are expressing the opinion that the crusade against Smoot is developing into a persecution. One of the leading western Democratic senators from a neighboring state to Utah said to the Herald correspondent: "The committee on privileges and elections should organise and take up the Sinoot case Immediately after the opening of the regular session. It should hear evidence to enable it to decide whether or not Smoot has violated any statute of the United States. If not the case against him should be dismissed and this hubbub stopped."
