The road in question, which intersects the 1300 block of Park Avenue from the east, was barricaded by Mrs. McPolin on June 4 in an attempt to establish her claim of ownership and prevent the city from taking over the land due to public ' use over a period of many years. : But. on July 16, city . employes , removed the barricades and Mrs. McPolin retained legal counsel to fight for the road. . In a letter dated August 26, and addressed to the Park City Corporation, McPolin's attorney Brent J. Giauque stated that his client received a letter from City Attorney Carl Nemelka advising her that unless the barricades were removed, the city would institute a lawsuit to have them removed. Giaque said his law firm was advised by Nemelka that "it was the position of Park City Corporation Corpor-ation that the public, not the city, had a prescriptive easement over the property in question." Giauque claims Nemelka was told that a reaction to the threat of the lawsuit would be forthcoming on July 19 but that Nemelka, "contrary to the understanding understand-ing which he had reached with counsel ' for Mrs. McPolin and to the intention-s intention-s of Park City Corporation," instructed the council on July 15 to have the barricades removed. Just before they took away the obstacles city employes Arvil Price and Paul Georgio were advised that they would be trespassing, Giauque said. Giving "willful, wanton and constituted trespass" as the. legal basis for claims, the letter states that Mrs. McPolin is asking' for a written agreement from the city demonstrating that ' "neither it, its officers, agents, or employees nor the public at large has any right, whether by prescription or otherwise,' to pass over or make any use of the property . of Mrs. McPolin described above." . w'' The letter continues,"If Park City Corporation is unwilling to enter into the agreement" claims would be made " for damages in the amount of $10,000 and for the diminution of the fair market value of Mrs. McPolin's interest in the property described above and for the sum of 000 as and for punitive or exemplary ex-emplary damages as a result . of the illegal activities of Park City Corporation detail- ad above."
